accessory use to the landscaping services business and the applicant is withdrawing his <br /> request for a wholesale nursery. <br /> Backaround <br /> The applicant involved in this project has been under enforcement since December 5, <br /> 2005. Enforcement action was taken due to the operation of a business without an <br /> approved land use permit and maintaining an illegal sign advertising the business. <br /> Approximately ten (10) employees of the applicant park their vehicles during normal <br /> business hours Monday through Friday (7:00 a.m. to 5:00 p.m.) and travel off-site to <br /> work for the landscaping services portion of the business. Another six (6) employees will <br /> work at the project site for the wholesale rock yard, which will operate Monday through <br /> Friday from 7:00 a.m. to 5:00 p.m. The Community Development Department has been <br /> working with the applicant to obtain the necessary permit to operate their business at the <br /> current location. This item, which would ordinarily be processed at the staff level, is <br /> being referred to the Planning Commission because of neighborhood opposition. <br /> Storm Drainage <br /> There are no public storm drainage services available to the project site. The applicant is <br /> proposing an on-site retention basin for the project. Development Title Section 9-1135.2 <br /> states that any additional storm water drainage created by new improvements shall be <br /> retained on-site. The drainage pattern and corresponding storm drain improvements <br /> shall be shown on the Site Plan. Drainage calculations prepared by a registered civil <br /> engineer or architect shall be included. <br /> Access <br /> The access driveway off of Fox Road shall have a width of no less than twenty-five (25) <br /> feet for two-way aisles and sixteen (16) feet for one-way aisles, except that in no case <br /> shall driveways designated as fire department access be less than twenty (20) feet wide <br /> (Development Title Section 9-1015.5). <br /> Parking and Surfacing <br /> Development Title Table 9-1015.3[b] states that the Nursery Sales-Landscaping <br /> Services use type requires 0.67 parking space per employee. As a result, a minimum of <br /> 13 parking spaces will be required, including one van accessible space. The applicant is <br /> proposing twenty-six (26) parking spaces, including one van accessible space, which <br /> meets the parking requirements. However, the applicant is proposing a twenty (20) foot <br /> wide, two-way driveway with nine (9) feet by thirteen (13) feet parking spaces. The <br /> Improvement Plan will be required to show a twenty-five (25) foot wide driveway and <br /> separately, nine (9) feet by twenty (20) feet parking spaces. <br /> All permanent parking lots (which include parking spaces, driveways, and maneuvering <br /> areas) in all zoning districts shall be surfaced and permanently maintained with asphalt <br /> concrete or Portland cement concrete to provide a durable dust free surface. Ingress <br /> and egress areas that connect to a paved road or highway shall also be surfaced and <br /> permanently maintained with asphalt concrete of Portland cement (Development Title <br /> Section 9-1015.5[e]). <br /> 2 <br />
