The Board of Supervisors approved the Text <br /> Amendment on March 9, 1993. The adoption of this Text Amendment permits the trade school <br /> to be constructed on this site provided the exterior noise does not create interior noise levels in <br /> excess of 45 dB Ldn. <br /> Robert Kupka, the owner of the Lodi Airport, is concerned that the school would be affected by <br /> the continued aircraft noise above the site. State law requires land uses within airport areas of <br /> influence to conform with the Airport Land Use Plan (ALUP), and in reviewing the application for <br /> compliance with the ALUP, the Council of Governments used Exhibit 11 of the Woodson Estates <br /> Environmental Impact Report, identified as 'Airport CNEL Contours, Future Average Annual Day, <br /> Regional Impacts.' This exhibit shows the 60 to 65 noise contour extending into the southern <br /> one-third to one-half of the parcel. <br /> The ALUP does not allow schools to be developed within the 60 to 65 dB contours due to the <br /> noise and potential hazard from the aircraft. To bring the application into compliance with the <br /> ALUP, Condition of Approval No. 6.a.from the Council of Governments shall not allow any school <br /> structures to be located within the 60 to 65 dB CNEL contour lines. <br /> Safety: <br /> Mr. Kupka is also concerned that the project is directly under the flight path of runway 26/08, and <br /> he states that the majority of the flights which arrive and depart from this airport fly directly above <br /> the location of the intended project. The airport itself has the following buildings located on its <br /> site: two houses, an office building, a restaurant, and 40 hangars. A letter from the State <br /> Department of Transportation, Division of Aeronautics, states that the proposed school site is <br /> beneath the traffic pattern for Lodi Airport's primary runway. According to Chris Ryan, an aviator <br /> consultant with the Division of Aeronautics, the proposed project is within the rectangular traffic <br /> pattern area of runway 26/08, but it is not under the flight track. He stated that the downwind leg <br /> of the approach that runs parallel to runway 26/08 would typically be one-haft to three-fourths of <br /> a mile to the north of the runway. The response from the Council of Governments states that the <br /> project site lies approximately 550 feet from the airport's runway and is within the transitional <br /> surface of the runway. <br /> Between the project site and the airport is the Jahant Road overpass, which crosses State Route <br /> 99. The approximate height from the railing of the overpass to State Route 99 is 261/2 feet, and <br /> then it slopes downward to the west, where it levels off at the junction of Woodson Road and <br /> West Frontage Road. The height of the proposed school building would be 14 feet. <br /> The Council of Government's response letter stated that the height of the proposed building <br /> exceeds a 100 to 1 slope imaginary line from the nearest point of the runway outward. Since the <br /> proposed 14-foot-high structure exceeds the height of 5.5 feet, the applicant must file a notice of <br /> proposed construction with the Federal Aviation Administration and comply with any FAA <br /> requirements. <br />
