Analysis <br /> Background <br /> This application is for the renewal of an expired Use Permit with some revisions, including a larger <br /> slaughterhouse building and a 4,000 square foot freezer. On February 2, 1995, the Planning Commission <br /> voted unanimously to approve Use Permit No. UP-94-14 for a wholesale slaughterhouse proposed by the <br /> same applicant at the same site as the subject Use Permit. This previous slaughterhouse was a <br /> somewhat smaller operation in square footage but was permitted to slaughter up to 500 hundred animals <br /> per day. This approval was appealed to the Board of Supervisors by the City of Lathrop, Larry Matlock, <br /> and Bennie Gatto. On April 25, 1995, the Board of Supervisors adopted Resolution No. R-95-198 to deny <br /> the appeal and approve the Use Permit. On December 19, 1996, the Planning Commission approved a <br /> one-year Time Extension to October 24, 1997. The Conditions of the Use Permit were not met in time, <br /> and the approved Use Permit expired and became void. <br /> The subject property was previously the site of a chicken ranch. The existing chicken house will be <br /> converted to the animal barn. <br /> Compliance Date <br /> Site visits revealed that certain aspects of the proposed operation have already commenced: the non- <br /> residential mobile home is already on the site, and meat trucks and animals were also observed. <br /> Because the facility appears to operational without benefit of the proper permits, a recommended <br /> Condition of Approval states that enforcement action will be delayed if the Site Plan is submitted within <br /> sixty (60) days and all Conditions of Approval are met within six (6) months. <br /> Neighboring Opposition <br /> The City of Lathrop, an organization representing itself as"Landowners of Lathrop," and two neighbors <br /> sent letters in opposition to the project. Several phone calls opposing the project were also received. <br /> Several concerns where expressed. These concerns include waste management, water quality, traffic, <br /> odors, flies, aesthetics, property values, and poor planning. <br /> As part of the previous Use Permit, the applicant obtained conditional approval for the slaughterhouse <br /> from the Central Valley Regional Water Quality Control Board (CVRWQCB). In its response to the <br /> subject Use Permit, the CVRWQCB indicated that the original requirements for the expired Use Permit <br /> shall be applied to this Use Permit. These requirements address waste management and water quality. <br /> In addition, the Environmental Health Division has reviewed and approved a Waste and Manure <br /> Management Plan. Both the requirements mandated by the Board and the Management Plan approved <br /> by Environmental Health address proper collection, storage and/or disposal of wastewater, blood, animal <br /> parts, tallow, and manure. <br /> Manure solids from the holding pens will be scraped to a concrete lined, covered manure storage area <br /> and transported off the site. Slaughterhouse operations will produce rinse water from the kill floor, blood, <br /> and solid animal wastes. Wastewater from the pens, kill floor, and other rinsing will be pumped to a lined <br /> wastewater treatment pond where it will periodically be discharged to a designated disposal area of triple- <br /> cropped sudangrass. Whole blood will be captured and stored in a tank for edible food processing and <br /> will not be discharged to the wastewater ponds. Solid animal wastes, including portions of the carcasses, <br /> fats, oils, and greases will not be discharged to the wastewater ponds. Fats, oils, and greases will be <br /> treated using a septic tank and a screened grease trap. Carcass portions (offal) and the fats, oils, and <br /> greases will be collected for rendering.
