k. ANIMAL REGULATIONS: The following animal regulations apply and shall be provided: <br /> (1) All animal enclosures, including but not limited to pens, cages, and feed areas, shall be <br /> maintained free from litter,garbage,and excessive accumulation of manure so as to discourage <br /> the proliferation of flies, other disease vectors, and offensive odors. The premises shall be <br /> maintained in a neat and sanitary manner. (DevelopmentTitle Section 9-1045.4[b]) <br /> (2) Except for movement on and off the property, animals shall not be kept or maintained in coops, <br /> pens, corrals, or within barns or similar structures, on property of less than 1/2 acre, closer than <br /> 40 feet from any rear or side property line. (DevelopmentTitle Section 9-1045.3) <br /> 2. DEPARTMENT OF PUBLIC WORKS (Staff Contact: Gabe Karam,468-3000) <br /> a. An encroachment permit shall be required for work within the road right-of-way. (DevelopmentTitle <br /> Sections 9-1145.4 and 9-1145.5) <br /> b. The driveway approach shall be improved in accordance with the requirements of San Joaquin <br /> County Standard R-17 prior to issuance of the occupancy permit. (DevelopmentTitle Section 9- <br /> 1145.5) <br /> c. The Traffic Impact Mitigation Fee will be required for this development. The fee is due and payable <br /> at the time of building permit application. The fee currently is$151.36 per additional daily trip-end <br /> generated in the Lathrop area. The fee shall be automatically adjusted July 1 of each year by the <br /> Engineering Construction Cost Index as published by the Engineering News Record. A credit may <br /> be allowed if it can be verified that the existing developmenton this site was in operation on or after <br /> April23, 1990. (ResolutionR-96-592) <br /> d. A copy of the Final Site Plan shall be submitted prior to the release of building permits. <br /> e. Verification shall be obtained from the Solid Waste Division(468-3066)that this development has <br /> addressed the items on the attached Waste Plan Format for Development Projects. <br /> 3. PUBLIC HEALTH SERVICES (Staff Contact: Rodney Estrada,468.0331) <br /> a. A soil suitability study/nitrate loading study which indicatesthat the area is suitable for septic tank <br /> usage must be performed prior to issuance of any permits,as required by Section 9-1105.2(d)of the <br /> San Joaquin County DevelopmentTitle. Should an addendum to the original nitrate loading study be <br /> necessary,a review fee of$390.00 must be paid at the time of submittal to the Environmental Health <br /> Division. <br /> The sewage disposal system shall comply with the on-site sewage standards of San Joaquin County <br /> prior to approval. A percolation test that meets absorption rates of the manual of septic tank practice <br /> or the EPA Design Manual for on-site waste water treatment and disposal systems is required for <br /> each parcel. A permit fee of$78.00 per percolation hole is required. <br /> b. Destroy any abandoned wells under permit and inspection by the Environmental Health Division. <br /> (DevelopmentTitle Section 9-1115.5[e]) <br /> c. State on revised plans the maximum number of employees the sewage disposal system is being <br /> designed for and that the leach field area will be barricaded so that it cannot be driven over, parked <br /> on, or used as a storage area. This leach field area must be used for that specific purpose only and <br /> cannot contain any underground utility lines.
