City of Lathrop <br /> Community Development <br /> Planning Division <br /> (209) 858-2860, Extension 327 <br /> (209) 858-5259 Facsimile <br /> STATEMENT TO SAN JOAQUIN COUNTY PLANNING COMMISSION <br /> JANUARY 6, 2000 <br /> By Pam Carder, Community Development Director <br /> The City of Lathrop is opposed to this application for a number of reasons, many of which you <br /> will hear about this evening. The application is for a Conditional Use Permit, which by its very <br /> nature means that you recognized the fact that the types of uses that would require a CUP might <br /> not be appropriate in all locations and circumstances. We contend that this is one of those <br /> locations and ask that you deny the permit. <br /> The proposed slaughterhouse is located approximately 1 mile from the existing City Limits and <br /> about 1,800 feet from the edge of the City's existing Sphere of Influence. On Tuesday, the City <br /> Council passed a resolution(attached)to apply for a Sphere of Influence expansion. This <br /> application has been submitted to LAFCO to extend our Sphere to Roth Road. If approved, this <br /> property would be within our Sphere of Influence. At the present time, we are processing a <br /> Specific Plan application to develop houses just 1,800 feet south of this site. This is much too <br /> close to ultimate residential development to put a slaughterhouse. People in the existing City <br /> limits have called us to complain about the odor from this property. These people are much <br /> more than 1,800 feet away and there are many less than 500 animals a day being slaughtered. <br /> There are some inconsistencies in the staff report which I would like to point out so that your <br /> decision can be made on the facts. The staff report incorrectly states that, although the <br /> previously approved slaughterhouse was somewhat smaller, the permit allowed up to 500 <br /> animals to be slaughtered per day. In statements before the Planning Commission and recorded <br /> in your 1995 minutes, both Don Moyer and Richard Stagno stated that they would be <br /> slaughtering about 50 animals per day in a custom slaughterhouse operation. Despite this <br /> statement, Mr. Stagno then submitted a manure management plan to the County Department of <br /> Health Services and a discharge permit application to the RWQCB for slaughtering 500 animals <br /> per day. Although only permitted for 50 animals under your approval, the RWQCB and the <br /> Health Department approved plans for 500 animals. <br /> The staff report also incorrectly says that manure will be transported off-site. The manure <br /> management plan approved by the Department of Health Services contains a 7,400 cubic foot <br /> manure storage area. This manure is to be stored for up to 120 days and then spread on the <br /> remainder of the property. Only if the remainder of the property cannot handle the nitrate load <br /> will the manure be trucked off-site and then only after it has remained on the property for 4 <br /> months. <br /> 16775 Howland Road, Suite One, Lathrop, California 95330 <br />
