Recommendations
Action
It is recommended that the Planning Commission:
1. Approve the Negative Declaration; and
2. Approve Site Approval No. PA-0500726 with the Findings and Conditions of Approval contained
in the staff report.
Findings
1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan,
any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan
adopted by the County.
• This Finding can be made because the composting facility proposed (Use Type:
Agricultural Wastes) in application PA-0500726 is permitted in the AG-40 zone with an
approved Site Approval application and is consistent with the A1G General Plan
designation and the County Right-to-Farm ordinance. There are no applicable San Joaquin
County Master Plans, Specific Plans, or Special Purpose flans in the vicinity. The City of
Lathrop has a Specific Plan that is within their city limits that designates the area to the
south of the project site as residential and commercial. However,to implement the
Specific Plan, the City will need to cancel or non-renew several Williamson Act contracts
south of the project site. This is not expected to happen within the lease period of the
composting facility.
2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary
facilities have been provided, and the proposed improvements are properly related to existing and
proposed roadways.
• This Finding can be made because all utilities, improvements, and other facilities are
existing or will be provided as reflected in the approved site and/or improvement plan(s).
Projects in the AG-40 zone may utilize a private septic system, an individual well, and on
site drainage. No new utilities are required or recommended. This project will use a private
septic system, an individual well, and on site drainage. Access is from Frewert Road,
which is a publicly maintained rural residential road.
3. The site is physically suitable for the type of development and for the intensity of development.
• This Finding can be made because the property is adequate in size to accommodate the
provisions of the Development Title. The parcel is 31.4 acres in size. The project will be
twenty acres in size when Phase 3 is complete. This parcel is flat, fallow land that has not
been cultivated in recent years. The parcel size permits adequate movement of all
necessary equipment, including fire suppression equipment. The parcel is surrounded by
other agricultural uses.
San Joaquin County PA-05007261Sanchez
Community Development Page 5
