Noise <br /> Currently, the existing operation uses a grinder that may exceed the noise levels <br /> contained in Development Title Section 9-1025.9(b) Stationary Noise Sources and Table <br /> 9-1025.9 Maximum Allowable Noise Exposure. The maximum Daytime stationary noise <br /> level may not exceed an Hourly Equivalent Sound Level (Leq) of 50 dB. The maximum <br /> Nighttime stationary noise level may not exceed an Hourly Equivalent Sound Level (Leq) <br /> of 45 dB. The maximum Daytime stationary noise level may not exceed a Maximum <br /> Sound Level (Lmax) of 70 dB and the maximum Nighttime stationary noise level may not <br /> exceed a Maximum Sound Level of 65 dB. These levels are measured at the property <br /> line or the Outdoor Activity Area. <br /> Manufacturer's data or other supporting information may be submitted for review by the <br /> Community Development Department to determine the need for a noise study. If the <br /> material submitted does not clearly indicate that the grinder does not exceed the <br /> maximum levels stated above, then a noise study will be required. <br /> Neicihborhood Opposition <br /> The Community Development Department received two letters of opposition to this <br /> project. The letters are concerned with traffic, odor, noise, and safety (fires). The <br /> Department of Public Works will discuss traffic issues. A traffic study is not required. <br /> The Environmental Health Department will discuss odor management. An odor <br /> management plan has been submitted. <br /> Noise and safety issues were discussed above. The applicant must be able to <br /> demonstrate that the project will not exceed the requirements contained in the noise <br /> ordinance. The Fire District will submit a new memo to add conditions of approval to the <br /> project to reduce the risk of fire. <br /> The application has been tentatively scheduled for the Planning Commission meeting on <br /> March 15, 2012. The Community Development Department has reviewed the project <br /> and responses from other agencies and, providing any outstanding issues have been <br /> resolved, will be recommending that the Planning Commission approve the Use Permit <br /> application subject to the following conditions of approval: <br /> Use Permit Application No. PA-1200011 was approved by the Planning Commission <br /> on . The effective date of approval is . This approval will expire on , which is 18 <br /> months from the effective date of approval, unless (1) all Conditions of Approval <br /> have been complied with, (2) all necessary building permits have been issued and <br /> remain in force, and (3) all necessary permits from other agencies have been issued <br /> and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements <br /> shall be fulfilled prior to the establishment of the use and the issuance of any <br /> building permits.
