(Habitat Assessment page'11 ) .The applicant <br /> will request coverage under the SJMSCP and comply with the measures in the <br /> SJMSCP and the Specific Plan'111 for the protection of kit fox. <br /> The rationale with respect to the third finding ("habitat of superior quality and <br /> superior or comparable quality will be created or restored to compensate for the <br /> loss") is as follows: <br /> The applicant,will create or restore habitat of superior quantity and superior or <br /> ;. . <br /> comparable'quality.to compensate for the loss of wetlands as result of the <br /> project. Replacement vegetation generally shall be native vegetation (General <br /> Plan,Volume 1, Policy VI, G, 15). <br /> c) 1.02 acres of wetland will be filled as a result of the project(Draft Wetland <br /> Delineation Report.Golden State Investments ll, LP Property February 2006). <br /> k The applicant shall replace the lost wetland with 1.02 acres of wetland <br /> (General Pian,Volume I, Policy Vi, G, 5; Master Plan, Implementation 7.3.6 <br /> (b)). <br /> d) The Wetland Plan shall be consistent with all Federal, State, and local <br /> 1 regulations (Master Plan, Implementation 7.3.6(k); Specific Plan 111, <br /> { Implementation Measure 7.3.4.3 (e)). <br /> e) The Wetland Plan shall show the location and extent of existing wetlands on <br /> the site of the proposed project. <br /> f) The Wetland Plan shall indicate sites that are to be developed or preserved <br /> to serve as mitigation for loss of wetlands as a result of the proposed <br /> project. To the extent practical, mitigation sites shall be in the Mountain <br /> House Creek corridor. If replacement in the Mountain House Creek corridor <br /> is not feasible, replacement shall be within San Joaquin County. <br /> g) Provisions shall be made for maintaining replacement wetland for a <br /> minimum of five (5)years. <br /> h) Assurance of wetland preservation shall be by conservation easement or <br /> other acceptable methods. <br /> In addition to the above,with regard to riparian habitat, the applicant will <br /> prepare a Riparian Habitat Mitigation Plan for the elimination of riparian habitat <br /> on the site, pursuant to Community Development Department Condition of <br /> I <br /> 3 <br />
