i Moreover, EIP's May 2006 field survey found that the existing Cali>iornia ground squirrel burrows within the project site did not contain any evidence-of suitable burrowing activity by.the kit fox. (Habitat Assessment page'11 ) .The applicant will request coverage under the SJMSCP and comply with the measures in the SJMSCP and the Specific Plan'111 for the protection of kit fox. The rationale with respect to the third finding ("habitat of superior quality and superior or comparable quality will be created or restored to compensate for the loss") is as follows: The applicant,will create or restore habitat of superior quantity and superior or ;. . comparable'quality.to compensate for the loss of wetlands as result of the project. Prior to the:approval of the Final Map(s)for the project, the applicant l will submit to the Community Development Department a Wetland Mitigation/Replacement Plan (Wetland Plan) prepared by a qualified biologist. The Wetlarid Plan will include the following provisions which are incorporated a as Tentative Map Conditions of Approval. M a) There shall be no degradation of the habitat or numbers of'a.ny rare, threatened, or endangered plant,or animal species as a result of the project. 1 b)' Wetland habitat of..'superior quantity and superior or comparable quality will be created or restored to compensate for the loss General Plan Policy VI, G, 1). Replacement vegetation generally shall be native vegetation (General Plan,Volume 1, Policy VI, G, 15). c) 1.02 acres of wetland will be filled as a result of the project(Draft Wetland Delineation Report.Golden State Investments ll, LP Property February 2006). k The applicant shall replace the lost wetland with 1.02 acres of wetland (General Pian,Volume I, Policy Vi, G, 5; Master Plan, Implementation 7.3.6 (b)). d) The Wetland Plan shall be consistent with all Federal, State, and local 1 regulations (Master Plan, Implementation 7.3.6(k); Specific Plan 111, { Implementation Measure 7.3.4.3 (e)). e) The Wetland Plan shall show the location and extent of existing wetlands on the site of the proposed project. f) The Wetland Plan shall indicate sites that are to be developed or preserved to serve as mitigation for loss of wetlands as a result of the proposed project. To the extent practical, mitigation sites shall be in the Mountain House Creek corridor. If replacement in the Mountain House Creek corridor is not feasible, replacement shall be within San Joaquin County. g) Provisions shall be made for maintaining replacement wetland for a minimum of five (5)years. h) Assurance of wetland preservation shall be by conservation easement or other acceptable methods. In addition to the above,with regard to riparian habitat, the applicant will prepare a Riparian Habitat Mitigation Plan for the elimination of riparian habitat on the site, pursuant to Community Development Department Condition of I 3
