Hold Harmless Provision: The subdivider shall defend, indemnify, and hold harmless the <br /> MHCSD, its agents, officers, and employees,from any claim, action, or proceeding against <br /> the MHCSD, its agents,officers, or employees, to attack, set aside, void, or annul an <br /> approval of MHCSD concerning any MHCSD condition, which action is brought within the <br /> time provided for in Section 66499.37 of the Government Code. <br /> 32. Landscapina and Architecture: <br /> A. The applicant shall adhere to the identity of the landscaping and architectural theme for <br /> Neighborhoods AIB. A distinct theme shall be utilized to ensure that the neighborhood <br /> shall be consistent with all Community Approvals including applicable provisions of the <br /> MHCSD Design Manual, Single Family Residential Design Manual, and any applicable <br /> Special Purpose Plan. Timing: Improvement Plans approved by CDD and MHCSD <br /> prior to approval of the first building permit. <br /> B. The applicant shall adhere to Landscape Guidelines for the entire AIB Neighborhood. <br /> All Landscaping and Street Tree planting within this subdivision shall conform to the <br /> Neighborhood AIB Landscape Guidelines, and shall be consistent with all Community <br /> Approvals including applicable provisions of the MHCSD Design Manual and any <br /> applicable Special Purpose Plan. Timing: prior to approval of the first building permit. <br /> C. Roadway, streetscape, and landscaping shall be designed consistent with all <br /> Community Approvals including applicable provisions of the Neighborhood AIB <br /> Landscape Guidelines, and MHCSD Design Manual. Timing: the design plans <br /> associated with each phase of the development shall be completed and approved by the <br /> MHCSD General Manager prior to the approval of the Final Map for that phase. <br /> b. The roadway landscape construction plans shall be processed and approved by the <br /> MHCSD General Manager concurrently with the Improvement Plans for any phase on <br /> the Neighborhood AIB development. <br /> E. The collector street network and landscape treatments shall comply with all Community <br /> Approvals including applicable provisions of the Neighborhood AIB Landscape <br /> Guidelines, the MHCSD Design Manual and MHCSD Standards. <br /> F. All residential lots that are siding or backing onto 'F' Street shall have Masonry Walls <br /> and Landscaping, installed within a 8 foot wide Landscape Easement, back of sidewalk <br /> on the Collector Street. Landscaping and masonry walls shall be designed consistent <br /> with all Community Approvals including applicable provisions of the Neighborhood AIB <br /> Landscape Guidelines, MHCSD Design Manual and MHCSD Standards, and shall be <br /> reviewed and approved by the MHCSD General Manager concurrently with the adjacent <br /> street Improvement Plans. Timing: Improvement Plans approved by CDD and MHCSD <br /> prior to first building permit. <br /> G. Landscaping and architectural design of all parcels designated as HOA or Landscape <br /> Maintenance District, shall be consistent with all Community Approvals including <br /> applicable provisions of the MHCSD Design Manual and MHCSD Standards. The <br /> design plans associated with each phase of the development shall be completed and <br /> approved by the MHCSD General Manager prior to first building permit. <br /> H. Masonry walls shall be installed at the property line between residential properties and <br /> all public or private parcels. Plans to be consistent with all Community Approvals <br /> including applicable provisions of the MHCSD Design Manual, MHCSD Standards, and <br /> any applicable Special Purpose Plan, Timing: Improvement Plans approved by CDD <br /> and MHCSD prior to first building permit.
