Analysis <br /> Background <br /> The subject parcels have a General Plan designation of A/G and are zoned AG-80 (General Agriculture, <br /> eighty-acre minimum). The parcels are currently used as pasture for cattle grazing. Neither of the project <br /> parcels contains a residence. <br /> The applicant applied for a Deviation application to reduce zone minimum from eighty(80)acres to seventy <br /> three(73) acres. The underlying project would likely be a Minor Subdivision to create four(4) parcels. Two <br /> parcels would contain eighty(80) acres, and two parcels would contain seventy three(73)acres. <br /> The Community Development Department denied Deviation Application No. PA-0500137 on May 18, 2005, <br /> based on the inability to make required Findings No. 2 and No. 3. An Appeal of Staff Action was submitted <br /> by Bill Carlson on June 17, 2005. <br /> Appeal Statements: <br /> "There are other properties near and contiguous to this property that have the same zoning but are less than <br /> 80 acres (zone minimum). There are some properties in the immediate vicinity less than zone minimum. <br /> There are many properties in the vicinity less than 80 acres; however, they are in Calaveras County." <br /> Response to Appeal Statements: <br /> The project parcels are currently zoned AG-80 (General Agriculture, eighty-acre minimum). Development <br /> Title Table 9-610.2 states that lots in the AG-80 zone shall be at least 80 acres. Finding No. 3 states, "The <br /> strict application of the regulation deprives the property of privileges enjoyed by other properties in the <br /> �- vicinity." With a few minor exceptions, parcels in the vicinity in San Joaquin County are 80 acres or larger. <br /> Parcels within Calaveras County are not in the jurisdiction of San Joaquin County.
