Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Deny the appeal of Deviation Application Number PA-0500137. <br /> Previous Findings <br /> 1. The granting of the Deviation will not be materially detrimental to other properties or land uses in <br /> the area. <br /> • This finding can be made because the parcels that would be created with a Minor <br /> Subdivision application, if the Deviation is approved, will be of adequate size to <br /> continue being farmed. The creation of two 80-acre and two 73-acre parcels will not <br /> be detrimental to surrounding properties that are also being used for agricultural <br /> purposes. <br /> 2. There are exceptional or extraordinary circumstances or conditions applicable to the property or to <br /> the intended uses that do not apply to other properties in the same zoning district in the vicinity. <br /> • This finding cannot be made because there are no exceptional or extraordinary <br /> circumstances applicable to the property that do not apply to other properties in the <br /> vicinity. <br /> 3. The strict application of the regulation deprives the property of privileges enjoyed by other <br /> properties in the vicinity. <br /> This finding cannot be made because there are no other properties in San Joaquin <br /> County within the project vicinity that are under the zone minimum of 80 acres. <br /> 4. The granting of the Deviation is consistent with the General Plan. <br /> • This finding can be made because the General Plan density of each parcel will still <br /> be met if a Minor Subdivision application is approved and two 80-acre and two 73- <br /> acre parcels are created.
