MS-92-155 OF THOMAS <br /> AND IRENE SHEPHARD (C/O R. W. SIEGRIED & ASSOCIATES) <br /> ----------------------------------------------------------------- <br /> This project is a minor subdivision of 1. 64 acres to create a <br /> 0. 95 acre parcel and a 0. 69 acre parcel. Proposed access for <br /> parcel 2 is a 20 foot easement over a gravel driveway which leads <br /> to a private right-of-way. Proposed access for parcel one is the <br /> existing 20 foot wide driveway leading to a private right-of-way. <br /> Background <br /> Variance No. VR-92-2 was approved by the Board of Supervisors on <br /> June 16, 1992 to reduce the required lot size from 40 acres to <br /> 0. 95 and 0. 69 . <br /> Oak Trees <br /> Over 60 oak trees with trunks greater than 6 inches in diameter <br /> exist on the site. Approximately half of those trees are on <br /> parcel 2 . The Initial Study for the Variance indicated that <br /> "subsequent development should not be permitted to occur within <br /> the drip line of the oak trees. " Conditions of Approval have <br /> been developed to mitigate the impact on the oak trees. <br /> Access <br /> Board of Supervisors Resolution 88-1200, regarding standard <br /> conditions for approval of a Private Right-of-Way, states, " (c) <br /> if a new parcel is being created, a maximum of six existing <br /> and/or potential lots may be served. " There are currently ten <br /> parcels with access on Helen Lane. This minor subdivision, if <br /> approved, will create the 11th parcel with access on Helen Lane. <br /> The Development Services Division, therefor, will refer this item <br /> to the Board of Supervisors for consideration. <br /> If this item is approved, the Development Services Division will <br /> recommend the following conditions: <br />
