24. Right To Farm Recordation And Notification: The deed of each parcel and of each <br /> condominium unit shall include the following recording notification, as specified by San <br /> Joaquin County Ordinance 4217 which added Section 6-9004 et. seq. to Chapter 1 of <br /> Division 9 of the San Joaquin County Ordinance Code regarding the Right to Farm Notice: <br /> "All persons purchasing lots within the boundaries of this approved map should be prepared to <br /> accept the inconveniences or discomforts associated with agricultural operations or activities, <br /> such as noise, odors, insects, dust or fumes. San Joaquin County has determined that such <br /> inconveniencies or discomforts shall not be considered to be a nuisance." <br /> Timing: Prior to approval of Final Map(s). <br /> NOISE <br /> 25. Outdoor Noise Levels: Best available noise reduction measures shall be implemented by <br /> the applicant to reduce noise levels in primary outdoor use areas(backyards) of new <br /> residential development to an Ldn of 60 dB. The subdivider shall specify what additional, <br /> reasonable measures have been taken in this regard. Where it is not possible to reduce noise <br /> levels to this level using practical application of the best available noise reduction measures, <br /> an exterior noise level of up to 65 db may be allowed. [Master Plan Policy 11.3.1 (e)] In the <br /> case that noise levels cannot be reduced to the design noise level of 60 dB, the applicant <br /> must provide notice via a note on the deed of each lot stating that exterior noise levels may <br /> exceed 60 dB. <br /> Timing: Inclusion of note on the Final Map approved by CDD prior to Final Map approval, and <br /> inclusion of note on deed prior to issuance of building permits. <br /> 26. Soundwalls and berms: The applicant shall construct sound walls at the locations and <br /> heights shown in Figure 5.11-1 of the Initial Study for Neighborhoods K and L at Mountain <br /> House. Along Mountain House Parkway wall heights shall not exceed 7 feet tall as <br /> measured from the adjacent pad grade. [Master Plan Policy 4.2.7 (e)]. Where any openings <br /> in soundwalls are proposed for pedestrian access, "return"walls shall be provided at the <br /> openings. These return walls shall continue along the depths of the adjoining residential <br /> yards and shall extend no less than to the rear yard setback. (This return wall requirement <br /> does not apply to "side on" lot conditions.) With respect to these return walls, CDD may <br /> allow the sound wall to be increased a maximum of one additional foot on the street side of <br /> the local road or collector street to compensate for varying pad height and berming on the <br /> adjacent arterial roadways. Entry walls into the neighborhood may be increased more than <br /> the additional one foot, subject to CDD approval. The proposed sound wall (or portion <br /> thereof)along these roads may be constructed to a height that is less than the height <br /> standard specified, subject to confirmation of a noise study prepared by a noise consultant <br /> approved by CDD and MHCSD. All sound walls would be constructed in accordance with <br /> the MHCSD Design Manual and MHCSD Standards. <br /> Timing: Improvement plans approved by CDD and MHCSD prior to first Final Map approval. <br /> 27. Noise Monitoring: The applicant shall conduct noise monitoring at homes within <br /> Neighborhood L that are in proximity to the MHCSD wastewater treatment plant. If <br /> measured noise levels are higher than the adopted standards, the applicant shall work with <br /> the MHCSD to incorporate mitigation (sound walls or housings) that would result in noise <br /> levels within Master Plan requirements. <br /> 28. Interior Noise Levels: Interior noise levels for housing proposed to be located in areas <br /> exposed to an exterior noise level of an Ldn above 60 dB shall be maintained at or below an <br /> Ldn of 45 dB. [SPIT Implementation Measure 11.2.1 (4)] <br /> Timing: Compliance verified prior to the issuance of building permits. <br /> Conditions of Approval -6- <br />
