2.SUMMARY MOUNTAIN HOUSE NEIGHBORHOODS KAND L INITIAL STUDY <br /> are not required when specific requirements are met. These requirements <br /> include the following:11 <br /> a. The lead agency for the MEIR is the same as for the subsequent project; <br /> b. The lead agency prepares an Initial Study on the subsequent project to <br /> determine if any additional significant effect on the environment could occur <br /> that was not addr e"ssed in the MEIR;and <br /> I <br /> c. The lead agency determines, on basis of written findings,that no additional <br /> significant environmental effect would result,that no new mitigation measures <br /> are needed, and that the project is within the scope of the MEIR. <br /> CEQA Guidelines Section 15179 states that the Initial Study done for a project <br /> that was the subject of a MEIR must make the following findings if more than five <br /> years have elapsed since certification of the MEIR: <br /> 1. There have been no substantial changes with respect to the circumstances <br /> under which the MEIR was certified;or <br /> 2. There is no new available information that was not known and could not <br /> have been known at the time the MEIR was certified. <br /> If this determination cannot be made,the standard Initial Study process will be <br /> used to determine the scope of an EIR for the project,or the need for a Mitigated <br /> Negative Declaration. <br /> The conclusion of this Initial Study is that, based on new available information, <br /> some potentially significant impacts could result from the project and a Mitigated <br /> Negative Declaration;w ould be appropriate for the project. In addition,the CEQA <br /> Guidelines have been amended since the MEIR was prepared and new topics <br /> such as greenhouse gas(GHG)emissions must be evaluated.
