<br /> Town Center is approximately 20 feet higher in elevation than the other portions due to the stockpiled soil
<br /> deposited there during construction. Underground utilities and an empty vault on a concrete pad are
<br /> located in a shallow excavated area in the central portion of Town Center.
<br /> 2.6 CURRENT USES OF THE ADJOINING PROPERTIES
<br /> For Neighborhood D, the western (Neighborhood C) and eastern adjoining properties are agricultural
<br /> lands with rural residences; two canals are located on Neighborhood C. The northern adjoining properties
<br /> for Neighborhood D are Neighborhood F, a residential development, and the southern adjoining
<br /> properties are rural residential and agricultural lands. For Neighborhoods K and L, the western, northern,
<br /> and eastern adjoining properties are agricultural lands (two mobile homes are located along the northern
<br /> side of the railroad tracks in Neighborhood J, the adjoining.western property). Neighborhood K's
<br /> southern boundary is Neighborhood J, currently agricultural land. The southern adjoining properties for
<br /> Neighborhood L include former agricultural lands currently being used to facilitate construction and
<br /> development of the town of Mountain House (south of Byron Road, Town Center), rural homes,
<br /> agricultural land, and the Mountain House Community Services Wastewater Treatment Plant (north of
<br /> Byron Road and east of Henderson Road). For Town Center, the southern (Neighborhood F), western
<br /> (Neighborhoods G and H), and northern (north of Byron Road, Neighborhood L), adjoining properties
<br /> include existing agricultural lands and former agricultural lands currently being used to facilitate
<br /> construction and development of the town of Mountain House. Town Center's eastern adjoining property
<br /> is agricultural land. .
<br /> 3.0 USER PROVIDED INFORMATION
<br /> 3.1 TITLE RECORDS
<br /> Old Republic Title Company Preliminary Title Reports dated September 28, 2004, March 3, 2004,and .
<br /> December 10, 2003, and Commonwealth Land Title Insurance Company Preliminary Report dated
<br /> r September 25, 2000,received from Trimark Communities, Inc, were reviewed as part of the ASTM Phase
<br /> I ESA for APNs 209-030-03 and -04; 209-040-09, -14,'and -17; 209-050-09; 209-170-02; and 209-450-
<br /> 11, -12, and --13. The Preliminary Title Reports indicate that there are several easements,,agreements,
<br /> and/or transfers (issues), affecting various portions of the Site, which include (not all-inclusive) the
<br /> following:
<br /> • Right-of-ways for electrical lines, irrigation and drainage,roads, poles, telephone and telegraph
<br /> lines, ingress and egress, oil and/or gas pipelines; and
<br /> • Access, easement, restriction, and development agreements (including water, levee, mineral and
<br /> hydrocarbon, storm and flood waters, seismic, and community).
<br /> Detailed information is contained within the preliminary title report copies contained in Appendix D.
<br /> 3.2 ENVIRONMENTAL LIENS OR ACTIVITY AND USE LIMITATIONS
<br /> An environmental lien is a charge, security, or encumbrance upon title to a property to secure the payment
<br /> of a cost, damage, debt, obligation, or duty arising out of response actions, cleanup, or other remediation
<br /> of hazardous substances or petroleum products upon a property. No evidence of any environmental lien
<br /> placed on the Site property was revealed in the course of this investigation. The San Joaquin County
<br /> Recorders Office records were not reviewed and only preliminary title records were provided by the one
<br /> of the owners(Trimark Communities, Inc).
