Analysis <br /> Background <br /> The site contains an orchard comprised of almond and peach trees. The applicant is currently excavating <br /> sand and gravel from an existing quarry (QX-99-03) approximately % mile south of the project area. QX- <br /> 99-03 is expected to be depleted in the year 2004—2005. This permit request will enable the applicant to <br /> supplement and combine aggregates from this site with materials obtained from other sources. The <br /> material that is excavated from the project site will be hauled to an existing processing plant <br /> approximately 2.1 miles West of the excavation site at 26292 East River Road, Escalon (QX-89-02). The <br /> processing facility was originally approved in 1989 as part of a quarry that would operate for a twenty- <br /> year period. On March 4, 1999 the Planning Commission approved a Revision of Approved Actions for <br /> Quarry Excavation No. QX-89-02. The Revision added 30 years to the life of the permit. <br /> Excavation <br /> The excavation of the site will begin along the southeastern property line and progress to the northwestern <br /> property line. Information submitted to the Community Development Department indicates that the average <br /> excavation depth will be 30 feet,with a maximum excavation depth of approximately 40 feet. The excavation <br /> will not reach groundwater depth. Reclamation is proposed to be continuous and concurrent with mining. <br /> The site will be approximately 25 to 40 feet lower than the current elevation when reclamation is complete. <br /> Williamson Act <br /> The proposed site is currently under the California Land Conservation Act. (Williamson Act Contract 72- <br /> C1-05). A Notice of Nonrenewal for this contract was approved in 2003- Development Title Section 9- <br /> 1810.3 (b)(1)(W) conditionally permits quarry excavation on parcels under Williamson Act Contract <br /> r. provided the land is rehabilitated for agricultural uses. The applicant is proposing to reclaim the parcel <br /> back to agriculture with the planting of almond and walnut trees. Additionally, peach and almond trees <br /> will continue to be farmed until excavation commences in each phase. Reclamation will proceed <br /> concurrently with each phase of excavation. This temporary disturbance to agricultural land is not <br /> considered significant. <br /> Department of Conservation(Office of Mine Reclamation) <br /> The Office of Mine and Reclamation (OMR) reviewed the proposed Reclamation Plan. In the memo dated <br /> August 18, 2004, OMR provided a list of supplemental information that needed to be provided in order to <br /> meet the minimum state requirements of the Surface and Mining and Reclamation Act (SMARA) and the <br /> State mining and Geology Board's regulations for surface mining and reclamation practices. The applicant <br /> submitted a revised Reclamation Plan, including the supplemental information, on September 7, 2004, that <br /> satisfied OMR's requirements. <br /> Noise <br /> The Community Development Department required that an acoustical study be performed to evaluate <br /> whether residences in the vicinity of the proposed quarry site would be exposed to noise levels from quarry <br /> equipment that would exceed the levels permitted in the San Joaquin County Development Title. <br /> Development Title Section 9-1025.9 requires that Residential use types have an outdoor activity area with a <br /> noise level of 65 db Ldn or less. Deem Shiningtree Environmental Services performed an acoustical <br /> analysis at an existing quarry excavation that was determined to be comparable to the topography an <br /> setting of the proposed quarry.
