Based upon the mitigation measures identified in <br /> the acoustical study, the following recommended Conditions of Approval were developed: <br /> 1. Retain a 300 foot setback from all property lines nearest to residential receptors for all loading and <br /> central activities related to excavation as shown on the site plan dated September 23, 2004, prepared <br /> by D.E.E.M Shiningtree Environmental Services and Earth Sciences. <br /> 2. Construct a 8 foot earthen berm along the northern, northeastern, and southeastern property lines as <br /> shown on the site plan dated September 23, 2004, prepared by D.E.E.M Shiningtree Environmental <br /> Services and Earth Sciences. <br /> Neighborhood Opposition <br /> The Community Development Department received seven (7) letters in opposition to the project and a <br /> signed petition with 67signatures. The following issues and concerns were addressed: lack of notification, <br /> proposed haul route and traffic, dust and air quality, depletion of water table, noise, aesthetics, and property <br /> value: <br /> Notification: Property owners within a 1,400-foot radius were notified of the proposed project, pursuant to <br /> Development Title Section 9-220.8. <br /> Traffic: The project location and excavation will occur along Hall Avenue, Henry Road, and Santa Fe <br /> Road. The applicant is proposing to transport the mineral deposits to an existing processing plant 2.1 <br /> miles away at 26292 East River Road. The haul route will use Santa Fe Road for ingress and egress and <br /> travel north to River Road. As a result of the proposed traffic generated from the project, the Department <br /> of Public Works required a traffic study. A traffic study was prepared by Dowling and Associates, Inc. <br /> The following mitigation measure is included in the recommended Conditions of Approval: <br /> 1. The applicant shall construct a 150-foot left-turn pocket for southbound Santa Fe Road at the <br /> project access point. <br /> With this mitigation measure in place, according to the traffic study, the proposed haul route and traffic <br /> will have a less than significant impact on existing levels of service for these roads. <br /> Air Pollution: The Air Pollution Control District considers that this project will most likely result in no net <br /> increase in emissions and dust because excavation will not commence at this project site until reclamation <br /> has begun on the previous site (QX-99-03), approximately 3/, mile south of the project area. This is not an <br /> expansion of the site, therefore, this represents a less than significant impact on ambient air quality. <br /> Water Table: The applicant is not proposing to drill an additional well and will continue to use water <br /> provided to the existing processing facility site. The current project proposes to excavate to a maximum <br /> depth of 40 feet below existing ground levels. The current groundwater elevation is 80 feet below existing <br /> ground levels. Therefore, there will not be a reduction in groundwater quality because the water table will <br /> not be touched during any excavation. <br /> Noise and Aesthetics The proposed quarry site is subject to noise regulations contained in Development <br /> Title Section 9-1025.9. Additionally, the quarry is restricted to the hours of operation between 5:00 a.m. and <br /> 9:00 p.m. pursuant to Development Title Section 9-1415.3(0. A 300-foot setback must be maintained from <br /> all property lines nearest to residential receptors for all loading and central activities related to excavation <br /> and will be placed as a condition of approval. <br /> San Joaquin County PA-0400250\Reed <br /> Community Development Page 4 <br />
