Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; <br /> 2. Approve Quarry Excavation Application No. PA-0400250 with the Findings and Conditions of <br /> Approval contained in the staff report; and <br /> 3. Approve the revised Hendrick Ranch Reclamation Plan dated September 2004. <br /> Findings <br /> 1. The proposal is for the removal of regionally significant or scarce deposits of mineral resources and <br /> not for the removal of prime farmland. <br /> • This finding can be made because the proposed project site has been identified as <br /> having significant deposits of sand and gravel by the Department of Conservation <br /> (Division of Mines and Geology) and classified within a Mineral Resource Zone 2 (MRZ- <br /> 2). Specifically,the site is being mined for sand and gravel materials and will not result <br /> in the removal of prime farmland because the site will be reclaimed to agricultural <br /> viability. <br /> 2. The proposed reclamation of the property upon completion of the excavation will leave the property <br /> in a condition, which will allow its reuse <br /> • This finding can be made because the site has been planted in peach and almond trees <br /> and, upon final reclamation, will continue to be used for farming purposes. Moreover, <br /> reclamation proceeds concurrently with the excavation process. Resident hybrid <br /> erosion control seed mix will be utilized in excavated areas for erosion control prior to <br /> orchard planting, as proposed in the Hendricks Ranch Reclamation Plan dated <br /> September 2004. <br /> 3. Issuance of the permit shall not be significantly detrimental to the public health, safety, or welfare, or <br /> be injurious to the property or improvements in the vicinity. <br /> • This finding can be made because there will be no excavation below the ground water <br /> table, and potable water services are to be provided on an existing quarry site. <br /> Additionally, an Initial Study prepared for this project identified traffic and noise impacts <br /> that can be mitigated to a less than significant level. The following mitigation measures <br /> are included in the recommended Conditions of Approval: <br /> 1. The applicant shall construct a 150-foot left-turn pocket for southbound Santa Fe <br /> Road at the project access point. <br /> 2. Retain a 300-foot setback from all property lines nearest to residential receptors for <br /> all loading and central activities related to excavation as shown on the site plan <br /> dated September 23, 2004, prepared by D.E.E.M.
