San Joaquin County August 26, 2004 <br /> PA-0400250 Page 2 <br /> (Fugitive Dust Prohibitions). The purpose of Regulation VIII is to reduce the amount of <br /> fine particulate matter (PM-10) entrained into the ambient air from man-made sources. <br /> Please be advised that the District is currently amending Regulation Vlll and <br /> anticipates implementing revised requirements on or about October 1, 2004. The <br /> applicant should contact the District to determine where requirements may have <br /> changed and how these rule changes may affect the project. <br /> This project will most likely be subject to the permitting requirements of the District. <br /> Any equipment subject to the District's Permit to Operate requirements must obtain an <br /> Authority to Construct (ATC) from the District. Construction of equipment that requires <br /> an ATC or construction of any intimately related appurtenances, such as foundations <br /> and utility hookups for the equipment, cannot begin until an ATC is obtained. This <br /> process can take up to 180 days. Construction of equipment not requiring a District <br /> permit is not subject to this ATC requirement. <br /> To determine specific permit requirements, the applicant should contact the District's <br /> Small Business Assistance Office at (209) 557-6446, or our Permit Services Section at <br /> (209) 557-6400. To avoid unnecessary delays in the project, this should be done as <br /> soon as the applicant has determined the scope of the project. <br /> Finally, District Rule 4103 regulates the burning of agricultural material. Agricultural <br /> material shall not be burned when the land use is converting from agriculture to <br /> nonagricultural purposes. In the event that the project burned or burns agricultural <br /> material, it would be in violation of Rule 4103 and be subject to District enforcement <br /> action. <br /> Thank you for the opportunity to comment.
