Surface and Subsurface ContMination Report—APN: 157-243-18—To create4ve(5)lot size parcels of <br /> about equal size, each containing at least 7,680 sq.ft., out of a larger 38,531 sq, ft. parcel. <br /> 2.1 Past Use Of The Site: As noted in the attached Environmental Questionnaire that is <br /> attached to and made an integral part of this report,the former property owners Beverly <br /> Newton and Charles McCleave have subjected the project site to agricultural use in the <br /> form of a family orchard. This agricultural use was not conducted for commercial, <br /> business or large income reasons and there is not enough acreage available to bring about (2, ()a high income potential from agricultural pursuits. Also the environmental questionnaire 1 2• () <br /> states in the past: (1) There has been no known use of the property for disposal of fuels, <br /> hazardous materials or chemicals,(2)There are no existing below ground cisterns, hand <br /> dug wells, or leach fields on the property, (3)No known flooding has occurred on the <br /> property and(4)No septic system has been known to fail on the project site. <br /> Beverly C. Lawton, Trustee of the Beverly C. Lawton 1997 Trust; Charles K. <br /> McCleave, Trustee of the Charles K McCleave 1998 trust; and Genevieve Sowell <br /> Sarabia,trustee of the Genevieve E. Sowell Separate Property Trust,dated October 10, <br /> 1997, as tenants in common granted the subject property to Madeliene G. Lawton Family, <br /> LP, a California limited partnership on December 25, 1999. The Lawton Family has <br /> owned the property in excess of five(5)years. No recorded transfer of ownership to US <br /> Properties Inc.,Mr. Stan Nixon Agent,was found when searching the San Joaquin <br /> County Assessor and Recorder Records on May 7, 2004. <br /> 2.2 Present Use Of The Site: The urban locale and streets in the area of the subject <br /> property are shown on the Vicinity Map insert on the attached Tentative Parcel Map. <br /> There are no buildings or structures presently on the created five(5)parcels. <br /> However,the subject property is in an urban area surrounded by homes except that about <br /> midway on the easterly boundary of the subject propert only natural ground exists and is <br /> identified as appraisal parcel no. APN: 157-248-06 on the attached Tentative Parcel Map. <br /> The subject property has been cleared of the natural grasses that have been <br /> growing on it in recent years, as well as many shrubs and trees, as shown on the <br /> photographs contained in Appendix I that is attached to and made an integral part of this <br /> report. The present property in recent years has been left in a natural state to grow grasses <br /> and shrubs and trees,but recently most of the grasses, shrubs and trees have been <br /> removed and the ground graded to almost a level state. <br /> 2.3 Zoning: The subject property has a General Plan R-L zoning classification as <br /> indicated on the attached Community Development Department's Main Page, which is <br /> attached to and made an integral part of the report. <br /> 2.4 Future Use Of The Site: After creation of the planned five parcels,there are three <br /> alternatives applicable to the future use of the subject property. The property owner will <br /> be able to sell the newly created five parcels in either a developed or an undeveloped <br /> state in the future or continue to leave it in a natural state as is being done presently.
