Recommendations
Action
It is recommended that the Planning Commission:
1. Approve the Negative Declaration; and
2. Approve the Revisions of Approved Actions application for Excavation Permit No. EP-84-10
based on the Findings and subject to the Conditions of Approval recommended in the staff
report.
Findings
1. The proposal is for the removal of regionally significant or scarce deposits of mineral resources
and not for the removal of prime farmland.
• This Finding can be made because the project site is recognized by the State of
California as regionally significant for its aggregate content and because the site will
be returned to agricultural uses following reclamation of the excavated areas of the
project site. The revision to the adopted Conditions of Approval will not adversely
affect either the excavation or reclamation of the site.
2. The proposed reclamation of the property upon completion of the excavation will leave the
property in a condition which will allow its reuse.
This Finding can be made because the agricultural viability of the excavated areas will
be improved by the removal of sand and gravel from the root zone. Following
excavation, the site's topsoil will be replaced and nutrients added to the soil to
further improve its viability. A farming lease will be negotiated to allow crop
production on the site after final reclamation. The revision to the adopted Conditions
will not alter the requirements for reclamation of the site.
3. Issuance of the permit shall not be significantly detrimental to the public health, safety, or welfare,
or be injurious to the property or improvements in the vicinity.
• This Finding can be made because all of the potentially significant, adverse
environmental impacts associated with the project can be mitigated to a less than
significant level. The revision to the adopted Conditions will not alter any of the
project's adopted mitigation measures or other Conditions of Approval.
San Joaquin County EP-84-10/Teichert
Community Development Page 6
