TEICHERT & SON, FOR A QUARRY EXCAVATION <br /> LOCATED SOUTHWEST OF LINNE ROAD AND MACARTHUR ROAD, <br /> SOUTH OF TRACY <br /> ---------------------------------------------------------------- <br /> On May 24 , 1984, the Board of Zoning Adjustment approved EP-84-10 <br /> subject to the attached conditions. Condition #20 stipulated <br /> that final cut slopes were to be no steeper than 2 : 1 (horizontal <br /> to vertical ) . Mr. Bruce Johnson, Vice-President/Manager of A. <br /> Teichert & Son, Inc . , appeared at the public hearing and did not <br /> object to Condition #20 at that time. <br /> After the May 24 hearing, a representative of A. Teichert & Son <br /> requested permission to establish final slopes of 1 . 5 : 1 . The <br /> requested modification requires the approval of the review <br /> authority (the Planning Commission, in this case) . <br /> Ordinance Code Section 9-2244 states, " . . . In any situation, tem- <br /> porary or permanent , where slopes exceed two ( 2 ) feet horizontal <br /> to one ( 1 ) foot vertical , a soils report of a qualified civil <br /> engineer shall be required which demonstrates that the com- <br /> position of the soil is of a type which will remain stable under <br /> the conditions imposed by the requested slope. . . . " <br /> Under a previous application, EP-79-8 , the applicant submitted a <br /> Soils Report in support of the request for 1 .5 : 1 slopes . Boring <br /> test samplings were limited to the Phase II area. Further stu- <br /> dies will be necessary to justify 1 . 5 : 1 slopes in Phase I and/or <br /> Phase III . <br /> Staff recommends that Condition #20 be modified to read as <br /> follows: <br /> 20 . Temporary and final slopes no steeper than 1 . 5 : 1 (horizontal <br /> to vertical ) are permitted in each excavation phase for which <br /> a soils report has been submitted to demonstrate that 1 . 5 : 1 <br /> slopes will provide stable soil conditions. However , at the <br /> required setbacks from County rights-of-way, the Delta <br /> Mendota Canal , the Banta Carbona Irrigation District Canal , <br />
