The <br /> schedule for rehabilitation will be a part of the approval of <br /> the excavation . It will define each phase of the excavation . <br /> The phases may be based on the sequence in which individual <br /> areas are to be excavated and rehabilitated, or on the <br /> sequence in which various operations are to be carried out on <br /> each area of the excavation. In either case , the rehabilita- <br /> tion schedule shall clearly state the operations to be <br /> carried out in each area during each phase . The cost of <br /> rehabilitation shall be determined for each phase in order to <br /> determine the amount of the performance 7uarantee . <br /> 16 . The excavation permit shall remain in effect as long as the <br /> excavation continues in comliance with the approved permit . <br /> If operations cease for a period of eighteen ( 18 ) months or <br /> more, the excavation permit shall terminate except for any <br /> requirements to rehabilitate the site . <br /> 17 . The applicant shall pay the current annual fee to the County <br /> of San Joaquin to cover the cost of periodic inspection of <br /> the excavation to assure compliance with the provisions of <br /> the permit . <br /> i The cost of the inspection shall be set by the Board of <br /> Supervisors . Routine semi-annual inspections shall be con- <br /> ducted by the Department of Public Works and other agencies <br /> deemed necessary by the Zoning Administrator to provide a <br /> complete review. If necessary, professional outside con- <br /> sultation shall be employed. The cost of such consultation <br /> shall be included in the inspection fee . Upon completion of <br /> the review, the Zoning Administrator shall prepare a written <br /> report for the Board of Zoning Adjustment and the operator - <br /> Additional inspections may be conducted, but the cost of <br /> additional inspections shall be paid for by the applicant <br /> only if noncompliance with the conditions of excavation per- <br /> mit is found. If the inspections reveal noncompliance with <br /> the approved excavation permit, the Board of Zoning <br /> Adjustment will conduct a revocation hearing . If the permit <br /> is revoked, any trust fund, performance bond , or other <br /> security provided for the project may be used to rehabilitate <br /> the property . <br /> 18 . A specific condition on performance guarantee is required to <br /> ensure rehabilitation of the site and compliance with con- <br /> ditions of approval . The amount of the guarantee will be <br /> based on the estimated cost of rehabilitation for each phase <br /> and will be fully in force for any phase which is being exca- <br /> vated or has been excavated but is not fully rehabilitated . <br />
