• Item <br /> PC : 5-17-84 <br /> EP-84-10 <br /> Page 7 <br /> The estimated cost of rehabilitating each phase as provided <br /> by the applicant shall be reviewed by the Department of <br /> Public Works at the time Of the application and every five <br /> ( 5 ) years after the approval of a permit . No financial <br /> guarantee will be required for areas not excavated . The <br /> review authority may modify the amount of the guarantee <br /> required based upon these reviews . When an inspection shows <br /> that a phase has been rehabilitated in conformance with the <br /> approved permit, the Zoning Administrator - will terminate the <br /> financial guarantee for that phase . On abandonment of the <br /> excavation for eighteen ( 18 ) months or more , bankruptcy of <br /> the operator or any occurrence which , in the opinion of the <br /> review authority, jeopardizes the rehabilitation of the exca- <br /> vation , the County may use all or any portion of the fund to <br /> rehabilitate the site . The, type of financial guarantee pro- <br /> posed by the applicant under this Section must be found <br /> acceptable by County Counsel prior to the public hearing on <br /> the permit . The type of financial guarantee may be, but is <br /> not limited to : <br /> a . A faithful performance bond . <br /> b . A property escrow or escrow account . <br /> c . A trust fund. <br /> 19 . Excavation shall be set back a minimum Cf 50 feet from the <br /> planned rights-of-way widths of MacArthur Drive, Linne Road, <br /> and Tracy Boulevard. Excavation shall also be set back a <br /> minimum of 50 feet from the Banta Carbona Irrigation District <br /> Canal , Corral Hollow Creek, and the We PaC :fic Railroad <br /> tracks . <br /> 20 . Final cut slopes shall not be steeper than 2 : 1 ( horizontal to <br /> vertical ) . <br /> 21 . The applicant shall submit a revised Exhibit A for approval <br /> by the Planning Division . <br />
