CONDITIONS OF APPROVAL <br /> OX-96-2 <br /> Olivia Traina Estate <br /> Quarry Excavation Application No. OX-96-2 was approved by the San Joaquin County Planning <br /> Commission on December 5, 1996. The effective date of approval is December 15, 1996. This <br /> approval will expire on June 16, 1998, which is 18 months from the effective date of approval, unless <br /> (1) all Conditions of Approval have been complied with, (2) all necessary building permits have been <br /> secured and remain in force, and (3) all necessary permits from other agencies have been secured <br /> and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been Identified as Ordinance requirements pertinent to this <br /> application. Ordinance requirements cannot be modified, and other Ordinance requirements may <br /> apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: (Staff Contact: Tom Gau, 209-468-2344) <br /> a. APPROVAL: This approval shall be for a phased six-year excavation of the 147-acre <br /> portion of the project site, as shown on the approved Mining and Reclamation Plan. <br /> b. RECLAMATION PLAN: The Mining and Reclamation Plan shall be prepared by a <br /> registered Civil Engineer, showing drainage, driveway access details, on-site parking, <br /> existing and proposed utility services, grading, and reclamation. Storm drainage runoff <br /> shall be retained on the site. The drainage pattern and corresponding storm drain <br /> improvements shall be shown on the Plan. A plan check fee as specified by Section 9- <br /> 240 will be required. The Mining and Reclamation Pian shall be prepared in accordance <br /> with the reclamation standards developed pursuant to Surface and Mining Reclamation <br /> Act (SMARA) Section 2773(b) and approved by all agencies with permit authority prior to <br /> initiating the use. <br /> C. STOCKPILES AND SCREENING: No stockpiled soil or material shall be placed closer <br /> than 25 feet to a property boundary except where shown on plans to provide a landscape <br /> berm for screening (provided that sight distances at road intersections are not impaired). <br /> (Development Title Section 9-1415.3[b]) <br /> d. PRIVATE ROADS: All private roads involved in an excavation shall be maintained so as <br /> to control the creation of dust. The first 100 feet of any private road on the property <br /> which intersects with a publicly maintained road shall be surfaced in a manner approved <br /> by the Director. Traffic-control and warning signs shall be installed, ff required, at such <br /> intersections. The placement and size of these signs shall be approved by the Director <br /> of Public Works. EROSION CONTROL: Protective vegetative planting,sift screen dams, or other approved <br /> methods shall be required where necessary for the control of erosion. An erosion and <br /> sediment control plan approved by Development Services Division shall be part of the <br /> reclamation plan.
