Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Quarry Excavation Application No. QX-96-2 subject to the Findings and Conditions <br /> of Approval contained In the staff report. <br /> Findings <br /> 1. The proposal is for the removal of regionally significant or substantial deposits of mineral <br /> resources and not for the removal of prime farmland. <br /> This Finding can be made because the project site is located within an area with <br /> substantial mineral resource deposits,topsoil will be stockpiled, and because the site <br /> will be returned to agricultural uses following reclamation of the excavated areas of <br /> the project site. <br /> 2. The proposed reclamation of the property upon completion of the excavation will leave the <br /> property in a condition that will allow its reuse. <br /> This Finding can be made because the site will be reclaimed to within 28 feet of the <br /> original ground surface with reclaimed soil in all excavated areas that will be mixed <br /> and placed according to the standards developed to maintain the site's agricultural <br /> fertility. The agricultural viability of the excavated areas will be improved by the <br /> removal of sand and gravel from the root zone. <br /> 3. Issuance of the permit shall not be significantly detrimental to the public health, safety, or welfare <br /> or be injurious to the property or improvements in the vicinity. <br /> This Finding can be made because all of the potentially significant, adverse <br /> environmental Impacts associated with the project can be mitigated to less than <br /> significant levels. <br /> San Joaquin County QX-96-2/Teichert <br /> Community Development Page 10 <br />
