Recommendations
Action
It is recommended that the Planning Commission:
1. Approve the Negative Declaration; and
2. Approve Quarry Excavation Application No. QX-96-2 subject to the Findings and Conditions
of Approval contained In the staff report.
Findings
1. The proposal is for the removal of regionally significant or substantial deposits of mineral
resources and not for the removal of prime farmland.
This Finding can be made because the project site is located within an area with
substantial mineral resource deposits, topsoil will be stockpiled, and because the site
will be returned to agricultural uses following reclamation of the excavated areas of
the project site.
2. The proposed reclamation of the property upon completion of the excavation will leave the
property in a condition that will allow its reuse.
This Finding can be made because the site will be reclaimed to within 28 feet of the
original ground surface with reclaimed soil in all excavated areas that will be mixed
and placed according to the standards developed to maintain the site's agricultural
fertility. The agricultural viability of the excavated areas will be improved by the
removal of sand and gravel from the root zone.
3. Issuance of the permit shall not be significantly detrimental to the public health, safety, or welfare
or be injurious to the property or improvements in the vicinity.
This Finding can be made because all of the potentially significant, adverse
environmental Impacts associated with the project can be mitigated to less than
significant levels.
San Joaquin County QX-96-2/Teichert
Community Development Page 10
