Box 15002 Fresno, CA 93711-3204 w — <br /> Sacramento, CA 95851-1002 N = -- <br /> NOTICE OF VIOLATION <br /> TRACYROCK, TRACY, SANJOAQUIN COUNTY <br /> The Regional Board has been informed of inappropriate wastewater discharge at the Tracy Rock facility. <br /> The Tracy Rock facility is owned or operated by Teichert Aggregates, Inc. and Calaveras Materials,Inc. <br /> A 5 March 2002 Report of Waste Discharge (RWD) submitted by Ameron Concrete and Steel Pipe <br /> Group (Ameron) which is located adjacent to the Tracy Rock facility, described overflows of wastewater <br /> discharging to the Tracy Rock wastewater ponds. <br /> Such a discharge is prohibited by WDR Order No. 5-01-144,Discharge Prohibition No. A.8,which <br /> states: <br /> The discharge or deposition of waste from sources other than from the sand and gravel operations <br /> at the Tracy Rock Plant or Flintkote property is prohibited. <br /> Teichert Aggregates' RWD (submitted on 10 January 2001) states that wastewater discharges from <br /> Ameron would cease on 13 February 2001 (see Finding No. 15 of the WDRs). The Ameron discharge is <br /> a material change to the quantity and quality of wastewater described in the 10 January 2001 RWD and <br /> shall immediately cease. <br /> By 19 April 2002, Teichert Aggregates and Calaveras Materials, Inc. shall either submit a report <br /> describing how the discharge has been controlled, or if Teichert Aggregates and Calaveras Materials, <br /> Inc. wish to allow the discharge to continue, a new RWD must be submitted. California Water Code <br /> (CWC) Section 13260(c)requires submittal of an RWD for a material change in the character, location, <br /> or volume of the discharge. Please contact Tim O'Brien at (916)255-3116 to discuss the requirements <br /> for an RWD if that is the option you select. <br /> Also note CWC Section 13264 describes prerequisites to wastewater discharge and CWC Section 13265 <br /> provides for civil penalties for discharging waste in violation of CWC Section 13264.
