Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Mitigated Negative Declaration; and <br /> 2. Approve Use Permit No. PA-0800005 with the Findings and Conditions of Approval contained in the <br /> staff report. <br /> Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, any <br /> applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan adopted <br /> by the County. <br /> • This Finding can be made because the expansion establishment, maintenance and operation <br /> of an existing solid waste processing and recycling facility on 51.7 acres does not conflict <br /> with the General Plan. The use proposed in application PA-0800005 is consistent with the AIG <br /> General Plan designation, which in turn may be conditionally permitted in the AG-40 zone. <br /> The proposed project is consistent with the 2009 Airport Land Use Compatibility Plan subject <br /> to the conditions of approval for the project.There are no Master Plans, Specific Plans, or <br /> Special Purpose Plans in the project vicinity. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This Finding can be made because adequate utilities, access roads, sanitation, drainage and <br /> other necessary facilities have been provided and the proposed improvements are properly <br /> related to existing and proposed streets and highways. The project will use a private septic <br /> system, individual well and on-site storm retention basin. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This Finding can be made because the project site is located on 51.7 acres.The site is <br /> rectangular in shape and partially situated 30-40 feet below the adjacent properties. The <br /> project site is of adequate size and shape to accommodate the proposed use and all yards, <br /> building coverage, setbacks, parking areas and other requirements of this Title. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, or be <br /> injurious to the property or improvements of adjacent properties. <br /> • This Finding can be made because the Initial Study and Mitigated Negative Declaration <br /> prepared for this project determined that with the proposed mitigation measures any <br /> potentially significant impacts will be reduced to less than significant. <br /> San Joaquin County PA-0800005\Tracy Material Recovery <br /> Community Development Page 7 <br />
