n) MITIGATION MONITORING PLAN: The applicant shall be required to comply with the Mitigation <br /> Monitoring Program identified as Attachment"A." <br /> i) Any mitigation monitoring done by the Community Development Department shall be done on a <br /> time and materials basis paid for by the applicant. <br /> 2) DEPARTMENT OF PUBLIC WORKS (Staff Contact: Alex Chetly, (209)-468-3023) <br /> a) An encroachment permit shall be required for work within road right-of-way. (Development Title <br /> Sections 9-1145.4 and 9-1145.5) <br /> b) The owner shall execute an Irrevocable Offer and Agreement to Dedicate Road to result in a forty- <br /> two(42)foot wide right-of-way from the centerline of MacArthur Drive to the property across the <br /> frontage of APN 253-130-26. (A fee based on the current fee schedule is required for processing <br /> the agreement per Development Title Table 9-240.2 as well as a copy of the most current grant <br /> deed of the subject property) (Development Title Section 9-1150.5) <br /> c) The entire route from the project site to Linne Road shall be kept clear of debris on a daily basis. <br /> d) All of MacArthur Road (from U.P.R.R. crossing to the south project access driveway)shall be <br /> improved to a traffic index(TI)of 9.5 prior to establishment of the use. All improvements shall be <br /> in conformance with the current Improvement Standards and Specifications of the County of San <br /> Joaquin. These improvement plans and specifications are subject to plan check,field inspection <br /> fees and must be approved by the County of San Joaquin Department of Public Works. Fees for <br /> plan check and field inspection will be based on the current Public Works fee schedule. <br /> (Development Title Section 9-240, Section 9-910, Section 9-1100 and R-92-814) <br /> e) The frontage improvements for MacArthur Road shall be constructed in conformance with the <br /> standards for one-half of an 84-foot wide right-of-way Rural Arterial Road. The construction of the <br /> frontage improvements will be deferred, upon execution by the owner of a Deferred Frontage and <br /> Roadway Improvement Agreement prior to release of building permit. (A fee based on the current <br /> fee schedule is required for processing the agreement per Development Title Table 9-240.2 in <br /> addition to the submittal of a copy of the subject property grant deed and an estimate of the <br /> proposed improvements. The estimate shall be prepared by a registered civil engineer with a <br /> typical section drawing on a form to be supplied by the Department of Public Works and submitted <br /> to the Department of Public Works for approval. As an option, the Department of Public Works will <br /> prepare the drawing with estimate for an additional fee)(Development Title Section 9-1150.2[d][41) <br /> f) The applicant shall enter in to an agreement to pay an annual road maintenance fee of$0.06 per <br /> equivalent ton of material entering the site. The fee is based upon the September 2011 ENR <br /> Construction Cost Index of 9,116, and will be adjusted annually. <br /> g) The Traffic Impact Mitigation Fee shall be required for this development. The fee is due and <br /> payable at the time of building permit application. The fee shall be automatically adjusted July 1 of <br /> each year by the Engineering Construction Cost Index as published by the Engineering News <br /> Record. (Resolutions R-00-433) <br /> h) The Regional Transportation Impact Fee shall be required for this development. The fee is due <br /> and payable at the time of building permit application.
