i l I Recommendations Action It is recommended that the Planning Commission:.. I 1. Approve the Negative Declaration; and 2. Approve the Revisions of Approved Actions application for PA-0200182 with a new expiration date of December 31, 2021; along with the previously approved Findings,Williamson Act Compatibility Prricipals, and Revised Conditions of Approval contained in the staff report. Previously Approved Findings 4 1. The proposal is for the removal of regionally significant or scarce deposits of mineral resources and not for the removal of prime farmland. This finding',;can be made because the Division of Mines and Geology classifies this site as a Mineral Resource Zone-3,which indicates that the site contains potentially significant deposits of aggregate resources. Topsoil and overburden will be continually reclaimed to the site as excavation proceeds. 2. The proposed reptamation of the property upon completion of the excavation will leave the property in a condition that wi If allow its reuse. This finding;can be made because the proposed reclamation plan provides for replanting the # site in walnut orchard with a sprinkler irrigation system. The reclaimed site will be relatively level. 3. Issuance of the permit shall not be significantly detrimental to the public health, safety, or welfare, or be injurious to the property or improvements in the vicinity. • This finding.-can be made because the Initial"'Study prepared for this project did not find any potentially significant environmental impacts. The project is not near any residences. The excavation equipment will not use public roads. The material will be processed at an existing facility. The project includes a buffer between the excavation and the Mokelumne River and its-riparian habitat. Williamson Act Compatibility Principles The use will not significantly compromise the long-term productive agricultural capability of the subject contracted parcel or parcels or on other contracted lands in agricultural preserves This finding can be made because the proposed use is for the extraction of salable aggregate material. Upon completion of project,the site will be reclaimed back to its current usejpf a walnut orchard.
