Revised Conditions of Approval <br /> Revisions of Approved Actions Quarry Excavation Application No. PA-0200182 was approved by the <br /> San Joaquin County Planning Commission on July 2, 2015. The effective date of approval is July 13, <br /> 2015. This approval will expire on December 31, 2023, unless (1) all Conditions of Approval have <br /> been complied with, (2) all necessary building permits have been secured and remain in force, and (3) <br /> all necessary permits from other agencies have been secured and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been identified as ordinance requirements pertinent to this <br /> application. Ordinance requirements cannot be modified; and, other ordinance requirements may <br /> apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: John Funderburg, [209]468-3160) <br /> a. APPROVED USE: This approval is for a Quarry Excavation to remove approximately one million <br /> cubic yards of rock, sand, and gravel from approximately 89 acres in three phases over a period <br /> of 20 4-8 years as shown on the revised site plan dated September May 5, 2015, and the <br /> amended reclamation plan dated September 17,201 D May 4, 2015. <br /> b. RIPARIAN HABITAT: Parallel to the Mokelumne River, a natural open space area for riparian <br /> habitat and waterway protection shall be maintained to provide for nesting and foraging habitat and <br /> the protection of waterway quality. The minimum width of said open space shall be one-hundred <br /> (100)feet, measured from the mean high water level of the natural bank, or fifty (50) feet back from <br /> the existing riparian habitat, whichever is greater. Water-dependent uses may be permitted in this <br /> buffer. The mean high water level and the edge of the riparian habitat shall be shown on the Site <br /> Plan. The open space buffer required above shall be shown on the Site Plans with the following <br /> note: <br /> Pursuant to Section 9-1510.5 of the San Joaquin County Development Title, this area is <br /> designated as a natura! open space for riparian habitat and waterway protection. No <br /> development other than water dependent uses shall be permitted in this space. <br /> The proposed berm shall be located outside the required open space area. <br /> c. CULTURAL RESOURCES: If, in the course of development, concentrations of prehistoric or <br /> historic-period materials are encountered, all work in the vicinity of the find shall halt until an <br /> archaeologist can evaluate the materials and make recommendations for further action. If human <br /> remains are encountered, all work shall halt in the vicinity, and the County Coroner shall be notified <br /> immediately. At the same time, a qualified archaeologist shall be contacted to evaluate the finds. If <br /> human burials are found to be of Native American origin, steps shall be taken pursuant to Section <br /> 15064.5(e) of Guidelines for California Environmental Quality Act. <br /> d. STOCKPILING: No stockpiled soil or material shall be placed closer than twenty-five (25) feet to a <br /> property boundary. (Development Title Section 9-1415.3[b]) <br /> e. PRIVATE ROADS: All private roads involved in an excavation shall be maintained so as to control <br /> the creation of dust. The first one hundred (100) feet of any private road on the property which <br /> intersects with a publicly maintained road shall be surfaced in a manner approved by the Director. <br /> Traffic-control and warning signs shall be installed, if required, at such intersections. The placement <br /> and size of these signs shall be approved by the Director of Public Works.
