STOCKTON September 24, 2014 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS Il,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 403 Failed to keep hazardous waste containers closed except when adding or removing hazardous waste. Two 55 gallon <br /> steel drums of used oil, a black plastic garbage can of used oil, a 5 gallon blue plastic bucket of used oil, and a 5 gallon <br /> blue steel bucket of used oil were observed behind the shop open, without lids. The used oil tank was observed with an <br /> open bung hole; the bung could not be located at the time of inspection. Three 55 gallon steel drums of used oil were <br /> observed in the shop pit storage area without lids. All hazardous waste containers shall be closed at all times except <br /> when adding or removing waste. Immediately close these containers and ensure all hazardous waste containers are <br /> closed when not adding or removing waste. This is a Class II violation. <br /> 501 Failed to comply with new hazardous waste tank system assessment requirements. Facility does not have a tank <br /> assessment for the used oil tank. Mr. Bongcaron estimated the tank to be 200 gallons. The owner or operator of a <br /> hazardous waste tank shall obtain a written assessment reviewed and certified by an independent, qualified, <br /> professional engineer, registered in California attesting that the system has sufficient structural integrity, is acceptable <br /> for the transferring, storing, and treating of hazardous waste, and that the tanks and containment system are suitably <br /> designed. Immediately have an assessment prepared for the used oil tank. Submit a schedule showing when this will <br /> be accomplished to the EHD. This is a Class I violation. <br /> 506 Failed to conduct daily inspections of hazardous waste tank system and maintain records onsite. Inspections of the <br /> hazardous waste tank system was not performed and documented. The following items are required to be inspected at <br /> least daily: <br /> 1. overfill/spill control equipment; <br /> 2. aboveground portions of the tank system to detect corrosion or releases of water; <br /> 3. data gathered from monitoring and leak-detection equipment; <br /> 4. outside areas of the tank system including secondary containment to detect erosion or signs of releases of <br /> hazardous waste; <br /> 5. for uncovered tanks, the level of waste in the tank. <br /> Immediately begin required inspections of the hazardous waste tank system, and document the items inspected. <br /> Submit a copy of the inspection log for the next 30 days to the EHD. This is a Class II violation. <br /> 605 Failed to completely label containers or tanks of hazardous waste. Two 55 gallon steel drums of used oil, a black plastic <br /> garbage can of used oil, a 5 gallon blue plastic bucket of used oil, and a 5 gallon blue steel bucket of used oil were <br /> observed behind the shop without labels. A 5 gallon blue plastic bucket of used oil was observed next to the used oil <br /> tank without a label. Three 55 gallon steel drums of used oil were observed in the shop pit storage area without labels. <br /> All hazardous waste containers shall be marked with the following information: <br /> -the words "Hazardous Waste" <br /> -name and address of generator <br /> -hazardous properties(ignitable, corrosive, reactive, toxic) <br /> -physical state(liquid, solid) <br /> -composition (contents) <br /> -accumulation start date <br /> Immediately label these containers and ensure that all containers are marked with all the required information. Since it <br /> cannot be determined how long the unlabeled containers of used oil have been on site, immediately contact a licensed <br /> hazardous waste hauler to dispose of this waste under manifest and submit a copy of the manifest to the EHD.
