PA-0400248 AND MAJOR <br /> SUBDIVISION APPLICATION NO. PA-0400789 OF SOLARI, ETAL (APN: 173- <br /> 210-04, 05, 06 & 07; ADDRESS:4860 E. MAIN STREET, STOCKTON) <br /> The applicant has submitted the above referenced Zone Reclassification application to change <br /> the zoning of approximately 27 acres of four parcels from AU-20 (Agriculture-Urban Reserve, 20- <br /> acre minimum lot size) to R-L (Low Density Residential), and the above referenced Major <br /> Subdivision application to subdivide the same property into 108 residential lots with a detention <br /> basin. Approximately 14 acres of the northwest portion of the four parcels have been deeded to <br /> the Stockton Unified School District as the future site of a proposed elementary school, and is <br /> excluded from the proposed application. The General Plan designation of the parcels is R/L (Low <br /> Density Residential). <br /> The project site is located on the south side of Main Street, between Coolidge Avenue and Del <br /> Mar Avenue, east of Stockton. Mormon Slough forms the southern boundary of the parcels. The <br /> parcels immediately south of Mormon Slough and east of the project site are used agriculturally <br /> and have a General Plan designation of R/L (Low Density Residential) and a zoning of AU-20 <br /> (Agriculture-Urban Reserve, 20-acre minimum lot size). The parcels to the north and west of the <br /> project site are residential and have a General Plan designation of R/L (Low Density Residential) <br /> and a zoning of R-L (Low Density Residential). The project site is located within the City of <br /> Stockton's Sphere of Influence. <br /> The Community Development Department has reviewed the proposed Zone Reclassification and <br /> Major Subdivision and offers the following comments: <br /> School Site and Detention Basin <br /> The proposed 14-acre elementary school site, located to the northwest of the project site, was <br /> part of the original four parcels of this proposed project. Title for the school site has been <br /> transferred to the Stockton Unified School District, and, therefore, is not a part of this project. <br /> Subdivision Map Act Section 66428(a)(2) states that a parcel map shall not be required for land <br /> conveyed to or from a governmental agency, public entity, public utility, or for land conveyed to a <br /> subsidiary of a public utility for conveyance to that public utility for rights-of-way, unless a showing <br /> is made in individual cases, upon substantial evidence, that public policy necessitates a parcel <br /> map. <br /> 1 <br />
