This assumption is based upon the southerly groundwater flow direction information indicated during the <br /> San Joaquin County Environmental Health Department file review for 150 N. Sinclair Avenue, Marley <br /> Cooling Tower Company Facility. <br /> bw <br /> 1.4 LIMITATIONS AND EXCEPTIONS <br /> The scope of this project was presented in our proposal and contract number 4568 dated October 28, <br /> ., 2004, and subsequently approved by the Client. Condor performed this environmental assessment in <br /> accordance with the guidelines set forth in the American Society for Testing and Materials (ASTM) <br /> Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process <br /> ` (Designation E-1527-94). The scope of work did not include other services that are not described in this <br /> report. Specifically excluded from the scope of work are (1) the evaluation of the Site for the presence of <br /> asbestos, radon, mold, and lead-based paint, (2) a survey of the Site for wetlands or rare and endangered <br /> species, (3)a survey of the Site for historical or cultural resources, and(4)research into the title history of <br /> the Site. <br /> This ASTM Phase I ESA is thorough, but is not intended to identify all potential concerns, or to eliminate <br /> all risk of the subject properties bearing some degree of environmental liability. Condor cannot and will <br /> not warrant or certify that the Site is free of contaminants because it is impossible to know if such a <br /> condition exists. Although risks can never be eliminated, more detailed and extensive investigations yield <br /> more information. This information may help you better manage your risks. Such detailed services <br /> involve greater expense. We ask our clients to participate in identifying the level of service that will <br /> provide them with an acceptable level of risk. <br /> Land use, Site conditions (both on-Site and off-Site), and other factors will change over time. Site <br /> activities and regulations beyond Condor's control could change at any time after the completion of this <br /> report. Our observations, findings, and opinions can be considered valid only as of the date of the Site <br /> visit. If any changes are made or errors found in the information used for this report, the interpretations <br /> and conclusions contained herein shall not be considered valid unless the changes or errors are reviewed <br /> by Condor and either appropriately modified or re-approved in writing. This report should not be relied <br /> upon after 180 days from the date of issuance(ASTM Standard E-1527-00, Section 4.6). <br /> The property owner is solely responsible for notifying all governmental agencies, and the public at large, <br /> of the existence, release, treatment, or disposal of any hazardous materials observed at the project Site, <br /> either before or during performance of Condor's services. Condor assumes no responsibility or liability <br /> whatsoever for any claim, loss of property value, damage, or injury which results from pre-existing <br /> hazardous materials being encountered or present on the project Site, or from the discovery of such <br /> hazardous materials. <br /> imp Condor, as an independent contractor, has completed the ASTM Phase I ESA in accordance with the <br /> ASTM guidelines and with the customary state of the practice and the prevailing standard of care for <br /> L completing such assessments in California at this time. Condor shall not be subject to any express or <br /> ` implied warranties whatsoever. <br /> This report and other instruments or service are prepared and made available for the sole use of the <br /> officers and representatives of Bennett Development, Inc.
