dairy operations. The applicant must contact APCD to determine the need for a Health Risk <br /> Assessment (HRA). If an HRA is required, the project will be placed on hold until the HRA is <br /> accepted by the APCD. The results of the HRA will be incorporated into the Initial Study. If an <br /> HRA is not required, written conformation to that effect will be required by the Community <br /> Development Department from the APCD. <br /> Opposition <br /> One letter was received in opposition to this project. The neighbor is concerned that other <br /> neighbors may want to subdivide their property in the same way, thereby creating a residential <br /> community. The letter stated that "we could end up with an unincorporated area of houses in a <br /> farming community that could adversely affect the farming in our whole community". <br /> This project meets Development Title criteria for subdivisions in the AG-40 zone. The project <br /> does not increase the density of existing parcels. It relocates sixteen parcels that do not have <br /> direct access to a county maintained road and locates them along Manteca Road and Melton <br /> Road. The purchasers of the parcels will be notified of the County Right-to-Farm ordinance. The <br /> right-to-farm ordinance requires that the following note be placed on the Final Map: <br /> All persons purchasing lots within the boundaries of this approved map should be prepared <br /> to accept the inconveniences or discomforts associated with agricultural operations or <br /> activities, such as noise, odors, insects, dust or fumes. San Joaquin County has <br /> determined that such inconveniencies or discomforts shall not be considered to be a <br /> nuisance. <br /> The application has been tentatively scheduled for the Planning Commission meeting on August <br /> 18, 2006, The Community Development Department has reviewed Major Subdivision <br /> application PA-0600346 and, providing any outstanding issues have been resolved, will be <br /> recommending that the Planning Commission approve the Major Subdivision application subject <br /> to the following conditions of approval: <br /> Major Subdivision Application No. PA-0600346 was approved by the Planning Commission <br /> on . The effective date of approval is . This tentative map approval will expire on , which is <br /> three (3) years from the effective date of approval, unless (1) all Conditions of Approval <br /> have been complied with and (2) a Final Map has been filed with and accepted by the <br /> County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements shall be <br /> complied with prior to approval of the Final Map. Those Conditions followed by a Section <br /> Number have been identified as ordinance requirements pertinent to this application. <br /> Ordinance requirements cannot be modified and other ordinance requirements may apply. <br /> 1.
