PA-0600346 OF CIRCLE JM DAIRY, <br /> INC. (C/O MOYER CONSULTING) (APN: 257-150-02, 257-220-07, 12, 13, AND <br /> 14; ADDRESS: 26626 S. MANTECA ROAD, MANTECA) <br /> This project is a Major Subdivision application for a vesting tentative map to re-subdivide 21 <br /> parcels that total 395.75 acres into 17 parcels of two acres each, one parcel of 40 acres, one <br /> parcel of 43.63 acres, one parcel of 109.61 acres, and one parcel of 160.78 acres. <br /> The project is located on the east side of S. Manteca Road and the north and south sides of E. <br /> Melton Road, 3.2 miles south of the City of Manteca. <br /> The Community Development Department has reviewed the project and offers the following <br /> comments. <br /> Density <br /> Development Title Section 9-905.9 (a) states that the area and width of lots or parcels in a <br /> subdivision map shall conform to the particular zoning district in which the property is located. <br /> Therefore, new parcels in the AG-40 zone must be a minimum of forty acres. However, Section <br /> 9-905.9(e)(2) states that any subdivision map that redesigns an existing subdivision in which the <br /> density of lots is not increased is not subject to the requirements of Section 9-905.9(@-d). There <br /> are twenty-four (24) legal lots within the five parcel numbers submitted with this application. <br /> These parcels are part of two antiquated subdivisions, Bret Harte Gardens and Melton Tract. <br /> The tentative map dated June 15, 2006 indicates the redesign of the twenty-four (24) lots into <br /> twenty-one (21) lots. Fewer lots means the density has decreased and therefore the subdivision <br /> is not required to conform to the forty acre minimum lot size requirement of the AG-40 zone. <br /> San Joaquin Valley Air Pollution Control District <br /> The Community Development Department sent a referral to the San Joaquin Valley Air Pollution <br /> Control District (APCD) on June 23, 2006. The APCD responded in a memo dated June 30, <br /> 2006. The memo states that the project is located in close proximity to three major dairies. As a <br /> result of the location, the 17 proposed residential homes may be considered sensitive receptors. <br /> There may be health risks to future occupants due to the emissions produced through normal <br />
