Mr. Karam reviewed the Public Wcirks Department requirements. An Irrevoeable Offer and Agreement to <br /> Dedicate Road to result in fifty-five (55) foot right-of-way from the centerline of Mariposa Road to the property <br /> line across the parcel's frontage will be required. <br /> Mr. Essin of the Solid Waste Division informed the applicant of the required Solid Waste Plan. Mr. Essin <br /> provided him with recycling forms, and reviewed the forms with the applicant. <br /> Mr. Huggins informed the applicant of the soil suitability study and septic tank system percolation test. <br /> 10:00 a.m. 2. SITE APPROVAL APPLICATION NO. SA-98-38 OF WILLIAM JR. & ROELYN <br /> JJ POOT. A Site Approval application for an existing retail nursery that has been operating <br /> without permits since 1986. Application to obtain status as non-conforming use under <br /> Development Title Section 9-235.7. Located on the north side of State Route 120, 2400 <br /> feet east of Murphy Road, north of Ripon (APN: 203-220-30; Address: 17229 E. State <br /> Route 120 Highway, Ripon). <br /> Jennifer Jolley, Associate Planner; William and Roelyn Poot, owners were present for this item. <br /> Ms. Jolley presented the project. <br /> Mrs. Poot indicated that the business was strictly retail and that there would not be any wholesale. Ms. Jolley <br /> indicated that she would revise the project description. <br /> Ms. Jolley, applicants, and staff discussed the possibility of a Lot Line Adjustment. <br /> Ms. Jolley said that there were 4 possibilities: <br /> a. Lot Line Adjustment <br /> b. Continue with the nol-buildable easement if able to obtain from the neighbor. Which would help <br /> as far as the Building Department is concerned, but would not solve the planning setback <br /> problems. <br /> C. Move the building. <br /> d. Apply for a Variance: or a Deviation application. <br /> Mr. Van Buren and Ms. Jolley discussed the functions of the different applications with the applicants. <br /> Ms. Jolley informed the applicants of the compliance date, which states that the applicant must submit plans for <br /> Improvement Plan/Building Permit within 180 days of the Approval date. Ms. Jolley said she would talk to <br /> enforcement and see if they would give an extension. <br /> Mr. Huggins reviewed Environmental Health Division's requirements. Mr. Huggins informed the applicants <br /> that the storm pond needs to be 10 feet away from the existing leach lines. Mr. Huggins also informed the <br /> applicants that they will need to install a cement surface seal around the well casing to sufficiently protect the <br /> well casing and the integrity of the well grout. <br /> Mr. Darrow discussed the Building setback regulations with the applicants. Mr. Darrow informed the <br /> applicants that exterior walls less that twenty (20) feet from the property line shall be of one (1) hour, fire <br /> resistive construction. Openings will not be permitted less than five (5) feet and protected less that ten (10) feet. <br /> Mr. Karam reviewed the Public Works Department requirements. <br />
