Findings
Development Title Section 9-878.4(b) states that for amendments to conditions of Use Permits, the Planning
Commission must find that all of the findings required for the discretionary application under consideration are
true.
A current Use Permit requires the same five findings as in UP-96-0002. The previously approved findings are
still true for the changes proposed for Condition 1.b. The extension of time for the completion of Phases 2
and 3 from seven years to twelve years does not require a change to the findings. Therefore, the previously
approved findings are still valid.
The previously approved findings are:
1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan,
any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan
adopted by the County.
• This finding can be made because religious assembly may be conditionally permitted in
the AG-40 zone with an approved Use Permit.
2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary
facilities have been provided, and the proposed improvements are properly related to existing and
proposed roadways.
• This finding can be made because all utilities, including water, drainage, sanitation, and
roadway improvements are Conditions of Approval and shall be in place prior to
occupancy of the facility.
3. The site is physically suitable for the type of development and for the intensity of development.
• This finding can be made because the Site Plan demonstrates that all requirements of the
zone can be met.
4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, or be
injurious to the property or improvements of adjacent properties.
• This finding can be made because an Initial Study prepared for this project found no
potentially significant public health and safety impacts.
5. The use is compatible with adjoining land uses.
• This finding can be made because, with the recommended Conditions of Approval, the
church facility will not interfere with or alter the current or future agricultural or residential
uses on adjacent properties.
Council of Governments
San Joaquin County is a signatory to the San Joaquin County Multi-Species Habitat Conservation and Open
Space Plan (SJMSCP). Participation in the SJMSCP satisfies requirements of both the state and federal
endangered species acts, and ensures that the impacts are mitigated below a level of significance in
compliance with the California Environmental Quality Act(CEQA). Participation in the SJMSCP is voluntary.
However, alternative mitigation in an amount and kind equal to that provided in the SJMSCP will be required.
San Joaquin County UP-96-0002/Southwinds Church
Community Development Page 4
