HENRY & LINDA TOSTA
TOSTA DAIRY
21070 Reeve Road
Tracy, California, 95376
209-836-1286
May 9, 1995 \
re: SA-94-44
Mr. Chandler Martin 00; Is .
San Joaquin County 'c
Community Development Department
1810 East Hazelton Avenue
S-ocktor: C 95205 / F
Ca,, Ci'N
Dear Mr. Martin:
We would like to respond to the recent correspondence
and events relating to our application for a dairy permit on
San Jose Road in Tracy.
1. The Naalee Burk Drainage Ditch. It is our under-
standing that the ditch adjacent to the property of Irene
Dirsina is a drainage ditch for the Naglee Burk district.
This ditch shall remain and be maintained as a drainage ditch
in the future.
2 . SJV Air Pollution Control District. We have every
intent to farm our property in a good farmerlike manner in
accordance with the customary and approved farming practices
of our vicinity and San Joaquin County. We will follow any
rules or regulations that may apply to an operating dairy and
we will make every effort to properly control and maintain
the buildings, fences and corrals included on the property.
If there are particular regulations that are of special
concern please inform us of their content.
3 . Correspondence from Ornellas Dairy. Mr. Ornellas
has raised several issues which are undoubtedly of concern to
us all . Operating a dairy facility himself, Mr. Ornellas has
seen first hand the undesirable effects of overcrowding and
an inadequate amount of acreage for the proper disbursement
of waste production. Mr. Ornellas has been misinformed,
however, as to the number of acres involved in our proposed
dairy facility and the surrounding farmland. Although the
dairy buildings will be located on one legal parcel of 39
acres, (larger than the Ornellas dairy site) , we will have
additional parcels contiguous to our dairy bringing our total
ownership to over 175 acres. In addition, more acreage will
be under lease, for a grand total of 235 acres.
It should also be pointed out that we plan to scrape the
manure into sealed lagoons and properly recycle the waste
material onto adjacent farm fields as fertilizer. We may
