Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Site Approval No. PA-04-78 with the Findings and Conditions of Approval contained in <br /> the staff report. <br /> Findings <br /> 1 The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, any <br /> applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • The Farm Services use type may be conditionally approved in the AU-20 zone with an <br /> approved Site Approval application. In order to make the findings for a Site Approval <br /> application, the project must be consistent with the General Plan, which is R/L (Low <br /> Density Residential). Although the Farm Services use type is not permitted in any of <br /> the urban zones that implement the R/L General Plan designation, the project may be <br /> considered to be consistent with the General Plan for the following reasons: <br /> a) The project does not involve a significant investment in facilities or permanent <br /> structures. <br /> b) The following condition will apply: <br /> 1. Within five (5) years from the effective date of a Zone Reclassification that <br /> changes the zoning from AU-20 to a zone that does not permit the <br /> approved use, the approved use shall either be terminated or changed to <br /> a use that is consistent with the new zone, unless the permit is extended <br /> by the granting authority. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> This finding can be made because additional utility and sanitation systems are not <br /> required, and even with the additional paving of the driveway and parking area, as <br /> reflected in the approved site plan, there is adequate room to contain storm drainage <br /> on-site. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because the property involved is of adequate size and shape <br /> to accommodate the proposed farm services business. The Site Plan shows that there <br /> is sufficient area for parking and circulation, in compliance with County Standards. <br /> There will not be a significant investment in facilities or permanent structures. <br /> San Joaquin County PA-04-78/Cordeiro <br /> Community Development Page 5 <br />
