CONDITIONS OF APPROVAL <br /> PA-0600418 <br /> Mossdale Associates <br /> Quarry Excavation Application No. PA-0600418 was approved by the San Joaquin County Planning <br /> Commission on March 15, 2007. The approval was appealed to the Board of Supervisors. However, <br /> the appeal was withdrawn on August 14, 2007. Therefore, the effective date of approval is August <br /> 14, 2007. This approval will expire on February 22, 2009, which is 18 months from the effective date <br /> of approval, unless (1) all Conditions of Approval have been complied with, (2) all necessary <br /> building permits have been secured and remain in force, and (3) all necessary permits from other <br /> agencies have been secured and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been identified as Ordinance requirements pertinent to this <br /> application. Ordinance requirements cannot be modified, and other Ordinance requirements may <br /> apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Kevin Swanson, 468-9653) <br /> a. IMPROVEMENT PLAN: Submit an "APPLICATION-SITE IMPROVEMENT PLAN". A fee is <br /> required for the Site Plan review. <br /> b. APPROVAL: This is an approval to mine and reclaim 14 million tons of sand and 8.3 million tons of <br /> soil of a 286 acre site from an existing 380 acre site in one phase over 35 years, as shown on the <br /> site plan dated September 29. 2006. The approval includes the Reclamation Plan dated September <br /> 29, 2006. All of the materials excavated shall be processed at the existing facility(QX-91-3). The <br /> excavation process shall be completed by July 29, 2039 and the site shall be fully reclaimed by July <br /> 29, 2041 <br /> c. CULTURAL RESOURCES: If, in the course of development, concentrations of prehistoric or <br /> historic-period materials are encountered, all work in the vicinity of the find shall halt until an <br /> archaeologist can evaluate the materials and make recommendations for further action. If human <br /> remains are encountered, all work shall halt in the vicinity and the County Coroner shall be notified <br /> immediately. At the same time, a qualified archaeologist shall be contacted to evaluate the finds. If <br /> Human burials are found to be of Native American origin, steps shall be taken pursuant to Section <br /> 15064.5(e)of Guidelines for California Environmental Quality Act. <br /> d. STOCKPILING: No stockpiled soil or material shall be placed closer than twenty-five (25) feet to a <br /> property boundary. (Development Title Section 9-1415.3[b]) <br /> e. PRIVATE ROADS: All private roads involved in an excavation shall be maintained so as to control <br /> the creation of dust. The first one hundred (100) feet of any private road on the property which <br /> intersects with a publicly maintained road shall be surfaced in a manner approved by the Director. <br /> Traffic-control and warning signs shall be installed, if required, at such intersection. The placement <br /> and size of these signs shall be approved by the Director of Public Works. (Development Title <br /> Section 9-1415.3[c]) <br /> f. EROSION CONTROL: Protective vegetative planting, silt screen dams, or other approved methods <br /> shall be required where necessary for the control of erosion. An erosion and sediment control plan <br /> approved by Development Services Division shall be part of the reclamation plan.
