1
Recommendations
Action
It is recommended that the Planning Commission:
1. Approve the Negative Declaration; and
2. Approve Quarry Excavation No. PA-0600418 with the Findings and Conditions of Approval
contained in the staff report.
Findings
1 The proposal is for the removal of regionally significant or scarce deposits of mineral resources and
not for removal of prime farm land.
• This finding can be made because the General Plan provides for the mining of
extractive resources such as sand. Also Development Title Section 9-854.2(c) states
that areas with an A/G (General Agriculture) designation may be excavated provided
the property to be excavated contains substantial mineral resources. The proposed
project site has been identified as having significant deposits of sand by the
Department of Conservation (Division of Mines and Geology) and classified within a
Mineral Resource Zone 2(MRZ-2).
2. The proposed reclamation of the property upon completion will leave the property in a condition,
which will allow its reuse.
• The finding can be made because upon final reclamation, a portion of the site will
continue to be used for agriculture and the remaining portion of the site will be
converted into a lake for aquaculture which will be stocked with channel catfish or
other marketable fish.
3. Issuance of the permit shall not be significantly detrimental to the public health, safety, or welfare, or
be injurious to the property or improvements to the vicinity.
• This finding can be made because there are no schools, churches, parks, hospitals,
within the project vicinity. Additionally, an Initial Study prepared for this project
indicated traffic and noise impacts would be of a less than significant level. Also,
during the course of excavation, no new buildings or utility systems are proposed, and
no permanent or temporary storage equipment areas are designated. All excavated
sand and gravel will be processed at the processing plant adjacent to the project site.
San Joaquin County PA-06004181Mossdale/Brown Sand
Community Development Page 5
