1 <br /> Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Quarry Excavation No. PA-0600418 with the Findings and Conditions of Approval <br /> contained in the staff report. <br /> Findings <br /> 1 The proposal is for the removal of regionally significant or scarce deposits of mineral resources and <br /> not for removal of prime farm land. <br /> • This finding can be made because the General Plan provides for the mining of <br /> extractive resources such as sand. Also Development Title Section 9-854.2(c) states <br /> that areas with an A/G (General Agriculture) designation may be excavated provided <br /> the property to be excavated contains substantial mineral resources. The proposed <br /> project site has been identified as having significant deposits of sand by the <br /> Department of Conservation (Division of Mines and Geology) and classified within a <br /> Mineral Resource Zone 2(MRZ-2). <br /> 2. The proposed reclamation of the property upon completion will leave the property in a condition, <br /> which will allow its reuse. <br /> • The finding can be made because upon final reclamation, a portion of the site will <br /> continue to be used for agriculture and the remaining portion of the site will be <br /> converted into a lake for aquaculture which will be stocked with channel catfish or <br /> other marketable fish. <br /> 3. Issuance of the permit shall not be significantly detrimental to the public health, safety, or welfare, or <br /> be injurious to the property or improvements to the vicinity. <br /> • This finding can be made because there are no schools, churches, parks, hospitals, <br /> within the project vicinity. Additionally, an Initial Study prepared for this project <br /> indicated traffic and noise impacts would be of a less than significant level. Also, <br /> during the course of excavation, no new buildings or utility systems are proposed, and <br /> no permanent or temporary storage equipment areas are designated.
