Specific Plan III Cost Reimbursement Fee. The developer shall pay the Cost <br /> Reimbursement Fee, if any, adopted for Specific Plan III. The fee will be placed in an <br /> interest bearing account managed by the Community Development Department. Upon <br /> recordation of the first Final Map, the fee shall be disbursed to the Master Developer of <br /> Specific Plan III (Gerry N. Kamilos, LLC). The total fee is currently . (The fee shall be <br /> automatically adjusted on July 1 of each year based on the change, if any, in the Consumer <br /> Price Index for Urban Wage Earners and Clerical Workers—All Items, published by the <br /> Bureau of Labor Statistics, U.S. Department of Labor(1967=100).) <br /> SJMSCP Fee. The developer shall pay the San Joaquin Multi-Species Habitat Conservation <br /> and Open Space Plan (SJMSCP)fee determined by the San Joaquin Council of <br /> Governments (SJCOG). <br /> Timing: Prior to approval of the Final Map(s), or prior to the issuance of grading permits for <br /> the project, whichever occurs first. <br /> 5. Final Map Digital File: A digital file of the Final Map shall be submitted to the Community <br /> Development Department. The digital file format shall be consistent with requirements of <br /> the County Assessor and Community Development Department GIS division. <br /> Timing: Prior to approval of Final Map(s). <br /> 6. Monitoring Agreement: The applicant or the applicant's assignee shall fund the Community <br /> Monitoring and Mitigation Monitoring Programs. The applicant or the applicant's assignee <br /> shall also fund the County's efforts to monitor compliance with the Tentative Map conditions <br /> of approval. Right To Farm Recordation And Notification: The deed of each parcel shall include the <br /> following recording notification, as specified by San Joaquin County Ordinance 4217 which <br /> added Section 6-9004 et. seq. to Chapter 1 of Division 9 of the San Joaquin County <br /> Ordinance Code regarding the Right to Farm Notice:"All persons purchasing lots within the <br /> boundaries of this approved map should be prepared to accept the inconveniences or <br /> discomforts associated with agricultural operations or activities,such as noise, odors, insects, <br /> dust or fumes. San Joaquin County has determined that such inconveniencies or discomforts <br /> shall not be considered to be a nuisance." [Implementation Measure 3.2.4.3.f] <br /> Timing: Prior to approval of Final Map(s). <br /> BIOLOGICAL RESOURCES <br /> 8. Participation In HCP: The developers of the Tentative Map shall request coverage under the <br /> SJMSCP. <br /> 9. Special-Status Plants: Before ground disturbance, pre-construction surveys for special-status <br /> plants shall be conducted by a qualified botanist in areas identified as suitable habitat by <br /> SJCOG at the appropriate time of year when the target species would be in flower or <br /> otherwise clearly identifiable. Surveys shall be conducted in accordance with specific <br /> methodologies described in Section 5.2.2.5 of the SJMSCP. <br /> If special-status plants are found, the following measures shall be implemented, depending on <br /> the species found: <br /> Sanford's arrowhead. Delta button-celery,and slouch thistle.The SJMSCP requires <br /> complete avoidance for these species;therefore, potential impacts on these species could not <br /> be covered through participation in the plan.
