the coroner determines that the remains are those of a Native American, he or she shall <br /> contact the Native American Heritage Commission(NAHC) by phone within 24 hours of <br /> making that determination(HSC Section 7050[c]). Once a Most Likely Descendent(MLD) has <br /> been designated by the NAHC, the MLD, in consultation with the County, shall determine the <br /> ultimate disposition of the remains. The responsibilities of the County for acting upon <br /> notification of a discovery of Native American human remains are outlined in detail in the <br /> PRC Section 5097.9. Measures likely resulting from the above could include preservation in <br /> place and capping/avoidance, or removal and continued monitoring of ground-disturbing <br /> activities. <br /> II. MOUNTAIN HOUSE COMMUNITY SERVICE DISTRICT (Staff Contact: Gabriel <br /> Karam 468-9997) <br /> GENERAL <br /> 1. All subdivision improvements including but not limited to subdivision improvement plans, <br /> specifications, master utility plans and any subsequent discretionary and ministerial <br /> approvals shall be in conformance with Community Approvals, including but not limited to the <br /> Improvement Standards and Specifications of the Mountain House Community Services <br /> District(MHCSD), the Design Manual, Master Plan, Mountain House Business Park, master <br /> utility plans, and other standards and plans adopted by the MHCSD. These improvement <br /> plans and specifications must be approved by the MHCSD prior to approval of each phased <br /> Final or Parcel Map and prior to any subsequent discretionary and ministerial approvals shall <br /> be subject to Design Consistency review.The plan check fees shall be made with the <br /> submittal of the improvement plans and the field inspection services costs shall be made to <br /> the MHCSD prior to signing of the improvement plans. If the actual costs exceed the <br /> estimated costs, the developer shall pay the balance within 30 days upon receiving an <br /> Invoice from the MHCSD. Final Maps shall be recorded with the following note: <br /> "All subsequent discretionary and ministerial approvals within the boundaries of this <br /> subdivision map shall be subject to Design Consistency Review and shall be consistent <br /> with the conditions of approval adopted for the Tentative Map." <br /> 2. The developer shall comply with all requirements of State, Federal, Mountain House <br /> Business Park initial study, including but not limited to County, State and Federal <br /> requirements relative to air quality, storm water discharge, waste disposal and hazardous <br /> waste and the mitigation measures contained in the Initial Study for the Tentative Map. <br /> 3. Prior to any construction, appropriate plans, operating procedures and safeguards shall be <br /> undertaken to insure safety in the area of fuel lines and pipelines, consistent with the MHCSD <br /> Emergency Preparedness Plan (see Emergency Pipelines Safety Plan). <br /> 4. All onsite and offsite easements and dedications shown on and proposed for the Tentative <br /> Map shall be dedicated to the MHCSD or offer of dedication to the MHCSD shall be recorded <br /> on the Final or Parcel Map. Dedication of public rights-of-way shall be in conformance with <br /> the adopted Public Land Equity Program (PLEP). Any easements to be abandoned that <br /> belong to Byron Bethany Irrigation District(BBID)shall not be abandoned without prior <br /> approval of BBID.Timing: condition shall be met prior to approval of Final or Parcel Map. <br /> 5. Prior to or upon filing of the first Final or Parcel Map as determined by the MHCSD General <br /> Manager, all rights-of-ways necessary to provide utilities and two points of access to all areas <br /> of Mountain House Business Park as shown on the Tentative map shall be dedicated to the <br /> MHCSD or offer of dedication shall be made to the MHCSD. <br /> 6. All services performed by the MHCSD on any development project will be paid by the <br /> applicant at the full cost including overhead as determined by the MHCSD General Manager. <br /> 8 <br />
