Analysis <br /> Background <br /> On March 13, 1969, the Board of Zoning Adjustment approved Use Permit application UP-4682 for the <br /> expansion of a non-conforming bar in a GA-5 zone on this parcel. The gas station was part of this permit. <br /> On June 30, 1977 the Board of Supervisors approved Reclassification Petition Z-77-61 of San Joaquin <br /> County to reclassify this parcel from GA-5 (General Agriculture-5 acre minimum)to C-RC(Commercial- <br /> Rural Center). <br /> On June 28, 1991, a demolition permit for a gas station was issued. The tanks and all structures were <br /> removed, and the site was cleaned up. <br /> On July 29, 1992, the parcel was rezoned from C-RC to C-X with the adoption of the General Plan 2010 <br /> and Countywide zoning update. <br /> There are currently no structures on the property. <br /> Residence <br /> The current owners of this parcel have an agreement to sell the property. The new owner would like to <br /> place a house on the lot for his primary residence. The C-X zone does not permit single-family dwellings. <br /> The AL-5 zone is a consistent implementing zone for the A/L General Plan designation. It is also <br /> consistent with the AL-5 zoning to the south, east, and west. A single-family dwelling is a permitted use in <br /> the AL-5 zone. <br /> Bases for Zone Reclassification <br /> Development Title Section 9-812.4 states that prior to approving an application for a Zone <br /> Reclassification, the Planning Commission and the Board of Supervisors shall determine that the <br /> proposed zone district is consistent with the General Plan, any applicable Master Plan, and any <br /> applicable Specific Plan and that the proposed zone district is reasonable and beneficial at the time. <br /> Both of these determinations can be made. The proposed AL-5 zone is a consistent implementing zone <br /> for the A/L General Plan designation. There are no applicable Master Plans or Specific Plans. A single- <br /> family residence is a permitted use in the AL-5 zone. The area to the south, east, and west is currently <br /> zoned AL-5. A residence is a less intensive use than commercial uses. The C-X zone was adopted <br /> when the site was occupied by a gas station and grocery store.
