CONDITIONS OF APPROVAL MS-91-45 PAGE TWO 2 . PUBLIC HEALTH SERVICES ORDINANCE REQUIREMENTS: The Ordinance Requirements listed below have been identified as pertinent to this project. Other Ordinance Requirements may also apply. Ordinance Requirements are not appealable. a. A soil suitability study as required by Section 10100 of the San Joaquin County Development Code must be performed prior to recordation of the Parcel Map or letter of approval indicating that the area is suitable for septic tank usage. A permit for the percolation test is required from the Environmental Health Division. b. Construct an individual sewage disposal system under a permit and inspection by the Environmental Health Division at the time of development for parcel one. c. Construction of an individual domestic water well under a well permit and inspection by the Environmental Health Division at the time of development on parcel one. d. The existing private water wells shall be tested for the chemical Dibromochloropropane (DBCP) and Nitrate prior to recordation of the Final Map. Samples are to be taken and run by a State-approved lab. e. Install an approved backflow prevention device on the water supply system. 3 . COUNTY COUNSEL ORDINANCE REQUIREMENTS: The Ordinance Requirements listed below have been identified as pertinent to this project. Other Ordinance Requirements may also apply. Ordinance Requirements are not appealable. a. Pursuant to Section 66474 . 9 of the Government Code, the subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and employees from any claim, action, or proceeding against the local agency or its agents, or its agents, officers, or employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, appeal board, or legislative body concerning a subdivision, which action is brought within the time provided for in Section 66499 . 37 of the Government Code.
