Recommendations
Action
It is recommended that the Planning Commission:
1. Approve the Negative Declaration; and
2. Approve Major Subdivision Application No. PA-0500730 with the Findings and Conditions of
Approval contained in the staff report.
Findings
In order to approve the proposed Major Subdivision application, the Planning Commission must make the
following Findings:
1. The proposed subdivision is consistent with the General Plan; any applicable Master Plan, Special
Purpose Plan, and any other applicable plan adopted by the county.
• This finding can be made because the Limited Agriculture (A/L) General Plan
designation and AL-5 (Limited Agriculture, 5 acre minimum) zone permits the
subdivision as proposed. The project complies with the General Plan density
requirements for the AIL designation (1 primary dwelling unit per 5 gross acres). There
are no applicable Master Plans, Specific Plans, or Special Purpose Plans.
2. The design or improvement of the proposed subdivision is consistent with the General Plan and any
applicable Specific Plan or Special Purpose Plan.
• This finding can be made because the design and improvements of the proposed
subdivision are consistent with the standards contained in the General Plan as
reflected on the Tentative Map. Each parcel will be served by its own on-site water
well, sewage disposal system, and storm water retention basin. There are no
applicable Specific Plans or Master Plans.
3 The site is physically suitable for the type of development proposed.
• This finding can be made because the site is physically suitable for the type of
development proposed and because the parcels all satisfy the minimum lot size and
width requirements for parcels in the AL-5 zone. The minimum lot size in the AL-5 zone
is five acres. The minimum lot width requirement is 200 feet (Development Title
Section 9-610.4). The proposed project meets the minimum requirements for this zone.
4 The site is physically suitable for the proposed density of development
• This finding can be made because the Tentative Map is consistent with the General
Plan density requirements of one dwelling unit per 5 gross acres in the A/L General
Plan designation. The 5-acre parcels are suitable for the proposed on-site water wells,
septic systems, and storm water retention ponds.
San Joaquin County PA-0500730\Perlegos
Community Development Page 4
