5 Neither the design of the subdivision nor any proposed improvements are likely to cause substantial <br /> environmental damage or substantially and avoidably injure fish or wildlife or their habitat. <br /> • This finding can be made because the design of the subdivision or the proposed <br /> improvements are not likely to cause substantial environmental damage or <br /> substantially and avoidably injure fish or wildlife or their habitat because the Initial <br /> Study prepared for this project did not identity any known rare or endangered species <br /> or habitats or other substantial environmental adverse effects. However,the Council of <br /> Governments has indicated the project is subject to the San Joaquin County Multi- <br /> Species Habitat Conservation and Open Space Plan (SJMSCP) as the project is located <br /> in an unmapped area. The applicant has contacted the Council of Governments to <br /> participate in the SJMSCP. <br /> 6. The design of the subdivision or type of improvements is not likely to cause significant public health <br /> problems. <br /> • This finding can be made because any studies required by the Environmental Health <br /> Department will address any issues with regard to public health. To ensure that San <br /> Joaquin County standards are met for the on-site septic systems, a Surface and <br /> Subsurface Contamination Report, Soil SuitablilitylNitrate Loading Study, and <br /> percolation tests shall be submitted and approved. For water standards, the existing <br /> water wells must meet the requirements for water quality. <br /> 7. The design of the improvements will not conflict with the easements acquired by the public at large for <br /> access through or use of the property within the subdivision <br /> This finding can be made because the design of the subdivision and the type of <br /> improvements will not conflict with easements acquired by the public at large for <br /> access through the property. In addition, Fire Marshal and Public Works' Conditions of <br /> Approval require the improvement of Tretheway Road. <br /> 8 Any land or improvements to be dedicated to the County or other public agency is consistent with the <br /> General Plan, any applicable Specific and Special Purpose Plan, and any other applicable plan for <br /> the County. <br /> • This finding can be made because the lands to be improved and dedicated to the <br /> County for the improvement of Tretheway Road are consistent with the General Plan. <br /> There are no specific Plans, Special Purpose Plans, or other applicable plans in the <br /> project vicinity. <br /> 9.
