The application consists of a General <br /> Plan amendment and a zoning reclassification that would change the property from <br /> General Agriculture with a 40-acre minimum to a Rural Residential development <br /> consisting of two acre lots. <br /> The Rural Residential designation does not comply with the General Plan. It is <br /> incompatible with agriculture. It creates a nuisance that is injurious to agriculture and <br /> Delicato Vineyards. <br /> The San Joaquin County General Plan requires Rural Residential land to be in rural <br /> communities and in urban communities with existing rural residential designations <br /> (Volume I, IV-18). The Loduca Trust property is in neither a rural or urban community. <br /> It cannot comply with the General Plan. <br /> The San Joaquin Development Title provides that Rural Residential Zones are typically <br /> in areas that`will contain parcels too small to support significant commercial agriculture, <br /> yet suitable for residential use without undue detriment to agricultural productivity of San <br /> Joaquin County"(OCSJC § 9-300.1(a)). The parcel size is over 16 acres. It contains <br /> prime soil. It is a viable agriculture parcel. It is surrounded by grapes, almonds, and row <br /> crops. Its development is without a doubt an undue detriment to the County's agricultural <br /> productivity. <br /> 4059261 Y <br />
