r Recommendations ; Action It is recommended that the Planning Commission: 1. Approve the Negative Declaration;and 2. Approve the Revisions of Approved Actions application for OX-89-0003 with a new expiration date of February 20,2030;along with the previously approved Excavation/Reclamation Plan and previously approved Findings and Revises!Conditions of Approval contained in the staff report. Previously Approved Findings 1. The proposal is for the removal of scarce mineral resources and not for the removal of prime farmland E because no topsoil will be removed, and only sand will be extracted from the site.Approximately 500,000 t cubic yards of sand will be excavated over a five-year period. 2. The excavation'will not have a detrimental effect on any surrounding agricultural land because dust control measures will be utilized during excavation and processing operations, excessive noise will not be generated on the site as a result of the project,and the days and hours of operation will be limited. 3. 'The proposed rehabilitation of the property, upon completion of the excavation,will leave the property in a condition which will allow its reuse because the reclamation proposed will result in the sand bar portion of the site being gently sloped down to the San Joaquin River,which will prevent that portion of the site from being subject to continued erosion during flood stages of the river. 4. Issuance.of the permit shall not be significantly detrimental to the public health,safety, or welfare or be injurious to the property or improvements in the vicinity anrt district in which the property is located because dust control measures will be implemented, no excavation activities will occur within the San Joaquin River, and a nine-acre wetlands area near the site will be created to off-set the loss of any vegetation from the project site. Revised Conditions i i Unless otherwise specified, the approved use shall not be established nor building permits issued until the applicant has fulfilled all Conditions of Approval. I 1. PLANNIN9 DIVISION ! a. The sandbar-skimming portion of the p project shall be. completed within five years of the commencement of operations. The on-going yearly maintenance skimming to maintain the n'ver sand bar shall be permitted for 45 35 years thereafter. If the excavation does not commence within 18 months after the date of approval, the permit is terminated. The applicant shalt notify the Planning Division in writing when the sandbar-skimming operations begin. The gua expiration date is February 20.2030. b. A performance guarantee is required to ensure site rehabilitation and compliance with Conditions of I Approval. The amount of the guarantee is and will be fully in force for any phase which is being excavated. The estimated cost of rehabilitating each phase must be reviewed by the Department of Public Works and the McMullin Reclamation District No. 2075.
